🚨 FORT WAYNE: A police officer tells a person filming an arrest: “If you don’t want to get involved, you’d better disappear.” The man on the ground says he cannot breathe. An officer says he is lucky he did not get more.

The clip is Saturday, about 12:30 a.m., Barr and Dewald. The man in cuffs is Rahiem Kubisty, 45.

Police say he ran from a traffic stop. The charges on him are resisting, fleeing, leaving the scene, and driving as a habitual traffic offender.

On the recording he asks for an ambulance. An officer says, “What do you need an ambulance for, big dog?” then “You ran from us.” After Kubisty says he did not deserve to get punched, an officer says, “You’re lucky you didn’t get more.”

Chief P.J. Smith said people can record and that those comments are under review. Two officers are on restrictive duty. FWPD has not named them. The chief said the review could take about a month, then bodycam comes out.

I cannot find a charging sheet on the officer who said “disappear.” Kubisty is the only defendant on a public file I can point to.
