The recent outing of @TheRoaringKitty (DFV) as a customer by @WSJ and @etrade raises serious privacy concerns. While DFV has voluntarily shared his trades and financial positions through his YOLO updates, this does not necessarily equate to giving explicit consent for financial institutions to disclose his customer relationship.
In the U.S., disclosing a customer's relationship with a broker without explicit consent can violate several privacy laws and regulations, including:
🔒 Gramm-Leach-Bliley Act (GLBA): This law mandates that financial institutions protect the confidentiality and security of their customers' nonpublic personal information. Even if a customer shares some information publicly, brokers must still comply with GLBA's stringent privacy requirements.
🔒 SEC Regulation S-P: Broker-dealers and investment advisers are required to adopt policies and procedures to protect customer information and provide privacy notices. This regulation emphasizes that firms must protect nonpublic personal information and ensure proper handling, regardless of any public disclosures by the customer.
🔒 FINRA Rules: These rules emphasize the importance of protecting customer information and maintaining high standards of commercial honor and integrity. Unauthorized disclosures can lead to severe penalties and damage to the institution's reputation.
Even though DFV has shared his financial updates publicly, financial institutions must navigate carefully to avoid unauthorized disclosures. The onus is on the broker to ensure they do not disclose any additional information beyond what the customer has already made public. This means even if a customer voluntarily shares their trading activity, it does not absolve the broker from their legal obligations to protect customer privacy.
