Já começam a aparecer, aqui é ali, aqueles argumentos pusilânimes que tudo justificam, segundo os quais seria inadmissível a desobediência a uma ordem judicial. Sobre essas falas rasas e hipócritas, vale recorrer à jurisprudência do próprio STF, de um tempo em que a alta corte de Pindorama ainda julgava com base na lei e na boa doutrina:
“Ninguém é obrigado a cumprir ordem ilegal, ou a ela se submeter, ainda que emanada de autoridade judicial. Mais: é dever de cidadania opor-se à ordem ilegal; caso contrario, nega-se o Estado de Direito.” (HC 73454, Relator(a): MAURÍCIO CORRÊA, Segunda Turma, julgado em 22/04/1996, DJ 07-06-1996 PP-19827 EMENT VOL-01831-01 PP-00125)
Imaginem se for expostas mensagens dos juízes auxiliares do min. Alexandre de Moraes dizendo que não encontram crimes contra Bolsonaro ou dizendo para manter o Cel. Cid e Filipe Martins na cadeia por tempo indeterminado para forçar uma delação fictícia?
When Justice Becomes Tyranny: The Allan dos Santos Case and the Farce of Brazilian Democracy
In a world where justice should be the central pillar of democracy, we are witnessing a case that reveals the dark side of tyranny masquerading as legality. The case of Allan dos Santos, a Brazilian journalist persecuted for expressing his opinions, exposes the farce that democracy in Brazil has become under the command of authoritarian figures like Alexandre de Moraes.
Glenn Greenwald, a journalist known for his fight for transparency and freedom of speech, has brought to light a series of shocking messages that reveal the behind-the-scenes workings of what can only be described as a modern witch hunt. According to these messages, members of Moraes's team discussed using extrajudicial methods to capture Allan dos Santos, including the suggestion to "send some henchmen to grab this guy by force and put him on a Brazilian plane." If this isn’t a threat to individual freedom, then what is?
But what exactly did Allan dos Santos do to deserve such persecution? He criticized institutions, denounced abuses of power, and defended values that many Brazilians share. He opposed censorship, corruption, and totalitarianism. And for that, he was declared an enemy of the state—not for committing violent crimes or organizing coups, but for expressing opinions that disturbed Brazil’s political elite.
What’s even more disturbing is the lack of response from Interpol and the U.S. government to the requests for Allan’s arrest and extradition. These entities, which are supposed to operate impartially, recognized what was really happening: an attempt to use international justice to persecute a political dissident. What should have been a legitimate legal process was exposed as a desperate attempt to silence an inconvenient voice.
Alexandre de Moraes and his cronies are frustrated. Frustrated because they can’t silence Allan dos Santos the way they want to, because international justice mechanisms still have some measure of integrity. And it’s precisely that integrity they seek to destroy. They don’t just want to imprison Allan; they want to make an example of him, a warning to anyone else who dares to challenge the status quo.
The real issue here isn’t just about Allan dos Santos. It’s about freedom of speech, the right to criticize the government, and protection against the abuse of power. If the Brazilian government can persecute someone like Allan, who will be next? Who will be the next to be hunted down, threatened, or even kidnapped for daring to speak the truth?
Brazil, like many other nations, is at a crossroads. The choice is clear: continue down the path of tyranny, where freedom of speech is crushed and power is exercised without restraint, or return to the path of true democracy, where dissenting voices are protected and respected.
Allan dos Santos is not just one man; he is a symbol of the fight for freedom against a system that seems increasingly willing to sacrifice individual rights in the name of its own power. And all of us, regardless of our political views, should be alarmed. Because when justice is manipulated to serve the interests of the few, we all become potential victims.
If Brazil truly wants to be a vibrant and respected democracy, it must show the world that it will not tolerate abuses of power, even when it means protecting those who speak out against the government. Allan dos Santos deserves justice, not vengeance. And Brazilian democracy, if it still exists, deserves to be saved from the tyranny of those who threaten it.
