📛⚠️ Important Judgment on GST Input Tax Credit (ITC);

📢 High Court directs dept to consider the assessee’s rectification application who mistakenly claimed ITC under the wrong head

➡️ The petitioner-assessee mistakenly claimed the entire input tax credit under CGST and SGST instead of IGST while filing monthly returns in GSTR 3B for July 2017.

➡️ Consequently, an assessment order was issued based on this incorrect claim.

➡️ The petitioner filed a rectification application, but no decision was made on it.

➡️ The writ petition sought a mandamus directing the respondent authority to set off the wrongly claimed input tax credit of IGST against the petitioner's output tax liability for the period from July 2017 to March 2018. The court held that the writ petition should be disposed of with a direction for the respondent authority to promptly consider and decide on the rectification application.

#delete_clause_44 #taxauditreport #form3cd @IncomeTaxIndia @nsitharamanoffc clause 44 of tax audit which requires gst related reporting is additional burden on businessman and auditors which serves no purpose. Request to delete the said clause

Due date for filing Income tax audit report FY 2019-20 was 15-01-2021, Naturally GSTR9 & 9C can only be done after that , Due dates for GSTR9 and 9C is 28-02-2021. Just 44 days?
