Tomorrow, in what is sure to be a well orchestrated production of self-aggrandizing and back-slapping, a group of California politicians and loyal lobbyists will gather to declare “Mission Accomplished” in the battle to address the retail theft crisis that has destroyed countless CA businesses, forced price increases & eroded the quality of life for all Californians.
In reality, their legislative package is almost entirely ‘all foam and no beer’ when it comes to providing truly effective tools to cops, prosecutors & judges seeking to hold repeat thieves accountable. Their package fundamentally fails to deliver as follows:
1) It DOES NOT authorize any enhanced felony penalty options for thieves who steal repeatedly (i.e. petty theft with priors), which was eliminated by Prop 47 in 2014, and which is the absolute nucleus of any meaningful fix to the retail theft crisis destroying CA;
2) It FAILS to authorize any enhanced felony criminal penalties for groups who commit brazen Smash and Grabs;
3) It promotes the fiction that the Organized Retail Theft laws, which have already been on the books in CA for years, are effective. In truth, the ORT law is rarely used by most prosecutors because it offers no additional penalties not already available in other laws, and it is extremely difficult to prove. Most experienced prosecutors think the ORT statute is essentially worthless;
4) And, their package completely FAILS to address the obvious connection between those who are homeless & seriously addicted to hard drugs who also steal to support their habit and survive.
Those on the front lines of public safety know that the only effective way to truly tackle the retail theft crisis destroying CA is by returning to the ballot in November 2024 and passing common sense amendments to Prop 47.

Urgent Message to all CA Police Chiefs, Sheriffs, DAs & LEOs - An imminent threat to our combined efforts to reform Prop 47 has been stealthily and cynically launched by the Governor & some Sacramento politicians & lobbyists, in a move that even some Democratic lawmakers have described as “deceitful,” “immoral,” and “undemocratic.”

Here is the situation:
Days ago, proponents of “The Homelessness, Drug Addiction and Theft Reduction Act” (a People’s Initiative that will qualify for the Nov 24 ballot) learned that the Governor’s office directed Sacramento lawmakers to insert a “poison pill” provision into their current package of bills dealing with retail theft and other crimes.
The purpose of the Governor’s “poison pill” language in the crime bills is to guarantee, subject to legislative votes, an automatic repeal of those same laws should the People’s Initiative be enacted by voters in Nov 24!
This unprecedented & unethical gamesmanship is designed to punish the voters of CA & anyone who might support the enhanced accountability sought by the People’s Initiative to amend Prop 47, which goes much further than the legislation to effectively address the fentanyl/drug, retail theft and homeless crises.
In addition, this “poison pill,” if successfully passed, will immediately trigger a critical rewrite of the “Official Title and Summary” of the People’s Initiative by the CA Attorney General. This is what voters will see on the ballot.
This is the potential political kill shot they seek!
As you know, a negative amended “Title and Summary” by the AG, as a result of the “poison pill“ legislation, could irreparably doom the People’s Initiative. This is 100% their goal & this perversion of Democracy is their play.
On Tuesday, June 11th, the bills with the new “poison pill” language will begin to be voted upon by politicians in the Capitol.
URGENT ACTION REQUESTED:
1) Contact your respective association leaders & lobbyists and ensure they “OPPOSE” any crime bills that contain the new “poison pill” unless that language is removed.
2) Contact your lawmakers and urge them to “OPPOSE” the “poison pill” perversion. Dems & Reps both know this 11th hour plot is undemocratic. Remind them.
3) Inform your business community and constituents of this outrageous situation & ask them to contact lawmakers.

The widespread availability of vaccines also raises an ethical question: Should children suffer to protect unvaccinated adults — who are voluntarily accepting Covid risk for themselves and increasing everybody else’s risk, too? Right now, the U.S. is effectively saying yes.
One reason: Severe Covid, including long Covid, is extremely rare in children. For them, the virus resembles a flu. Children face more risk from car rides.
They also face more risk - to their mental health, emotional development and physical well-being - from closed schools.
Data now suggest that many changes to school routines are of questionable value. Some researchers are skeptical that school closures even reduce Covid cases. Other interventions, like forcing students to sit apart from their friends at lunch, may also have little benefit.
Bottom line: For the past two years, large parts of American society have decided harming children was an unavoidable side effect of Covid. And that was probably true in the spring of 2020, when nearly all of society shut down. It's been less defensible since then.
