Theatre of the absurd. NC and BJP protesting against each other.

Spare a thought for the protesting medical interns. They are the academic cream of J & K. They are protesting against the pittance that they are paid.

The pain of the protesting medical interns is the real pain. Please could the two ruling parties NC and BJP stop this theatre and let the focus be on the protesting interns.

OBITUARY OF GOVERNANCE

Two news items about the elected government that caught my attention.

The first was news and photos of CM sahib inaugurating a slew of projects in his Assembly constituency Ganderbal. He was accompanied by two ministers. So Chief Minister and two Ministers spent a day in an Assembly constituency.

The second news item was about the rest of 3 ministers taking a review of each other’s constituencies in the Secretariat along with the officers. My sympathy with those IAS officers who have worked hard to pass the IAS exams, having to sit with three ministers to review the respective constituencies of three ministers.

What model of governance is this? So the entire cabinet comprising of five minsters and CM sahib, basically spent the entire day visiting or reviewing 4 Assembly constituencies.

We have a cabinet of 6. And 4 Assemblies were reviewed or visited. So for every one ministerial or chief ministerial assembly constituency, 1.5 ministers spent the day reviewing or visiting it.

Where do you guys get so much time. Running one department is so time consuming. That is, if you are actually running the department. You have 4 to 5 departments each. And that too big ones. And the superman CM sahib has I think 32 or 29.

Are you running the department or is the bureaucracy running them for you. Why vote, why have elections if the same bureaucracy has to run departments after elections. Has the political contribution to governance now relegated to transfers and maybe some retributive actions. Is that all.

This is not politics I am indulging in. This is a an obituary of our governance. While government is tottering and failing to meet expenditure targets, while the treasuries run dry, the ministers are busy reviewing each other’s constituencies.

And they are so bright. They don’t know that you don’t publish such gibberish in newspapers.

Mark my words. This government will go down in history as one of the most invisible and inefficient governments’.

And also mark my words. You guys will beat your own record of failure set by you in the period 2008-2014.

AFFIDAVIT OF YASIN MALIK

I have read the entire 85 pages of Yasin’s affidavit. Two things are clear:-

This affidavit is not about the person of Yasin Malik.
This affidavit is not about clemency.

This affidavit is about sanctity of the institution of dialogue and threats to its sanctity.

This is a first person account of a Kashmiri who has hundreds of cases slapped against him and has been convicted for life and the prosecution is seeking death penalty

It is based on real life events.
Please do not pass it off as yet another affidavit. It is in essence an academic analysis of the powerfulness or the powerlessness of the institution of dialogue to resolve conflicts. It symbolises the relevance or the irrelevance of the institution of dialogue specifically in the context of this region.

It addresses variables like truthfulness, trust, politics of promises and the politics of reneging on those promises. These variables maybe invisible and pushed to the sidelines, but they are important if the institution of dialogue is to have sanctity and deliverability in the future.
As per the affidavit, Yasin it seems all along believed that his engagement with Delhi was a part of a semi formal dialogue process. While Yasin believed he was taking part in dialogue process, he now retrospectively feels that Delhi was using dialogue as a ploy to practice statecraft albeit negatively.

Students of politics, academics and most importantly aspiring peace makers need to delve deep into this rare document. This comes from a person who has seen it all and shares his experiences. Academically it is a rarity. It illustrates how abandoned dialogue processes stigmatise the institution of dialogue. Equally important is the lesson that dialogue processes should not be totally shrouded in anonymity.

This world will never be free of rebels or rebellions. There will be conflicts. The means to resolve a conflict are broadly two. It is either violent means or non violent means. If a state is seen as using dialogue to not resolve a conflict, but to slander and tarnish the opponent it means it is inadvertently encouraging violent means of conflict resolution. I am just giving an academic perspective. The loss of space in a proposed dialogue process is ceded to violence.

The onus to explain whether Delhi believes in the institution of dialogue or not, is on Delhi. And in the context of the affidavit it is deeds which would matter more than words. Ironically the pattern of engagement and reneging on promises has been the same across party lines. On the use of dialogue as a tool of deception, all political parties and all bureaucratic institutions seem to perfectly overlap.

Either the actors and institutions named in the affidavit, deny what has been said in the affidavit.
OR they accept that they did not believe in engagement when they were in a state of engagement with Yasin. And the engagement was a farce.
OR
they take decisions pertaining to Yasin in the spirit of dialogue and engagement as promised to him.

Such an outcome would accord sanctity to the institution of dialogue and be a reference point for future peace makers for resolution of conflicts.

The present political and bureaucratic establishments will not rule for all times to come. Evolution will take place. Newer actors will be in power. And even newer mindsets. Maybe at a future date a certain set of rulers would want reconciliation and dialogue. What you do with Yasin today will be an asset or a liability for the rulers of the future. Participants in a dialogue with Indian state would look at the empirical evidence of how state has conducted dialogue in the past. Dialogues held in the past will be indicator of how truthful and trustworthy the state is.

There are attempts being made to tactfully denigrate this work by trying to pass the affidavit off as something which it is not. Yasin had decided to not contest the case.Which is totally different from pleading guilty

Putting politics aside, Khawaja Abdul Gani Lone stepped forward after the @BBC abandoned me and those I trusted proved untrustworthy following the deadly parcel bomb explosion at my Srinagar office-cum-residence on September 7, 1995.

Facing financial hardship, I was offered monetary support by Lone Sahab, who also promised “all possible help, including money” if I chose to start my own newspaper. He spoke with empathy and warmth, like a compassionate and caring father figure

I thanked him, expressing my faith that Allah (swt) would guide me through. My optimism was not misplaced.

We will support any movement towards statehood.
But please don’t make a mockery of statehood. We are already reeling under the impact of a “Tom Dick and Harry” approaching the Supreme court.

Let us approach the Supreme Court as a constitutional entity not as another “Tom Dick and Harry”. Signature campaigns have no legal or constitutional sanctity.

Can CM sahib please once and for all times to come explain his reluctance of having a resolution for statehood passed in the Legislative Assembly.

The Legislative Assembly is a constitutional body elected through an election. And the election has been conducted by another constitutional body called Election Commission of India. Out resolutions are not binding on the Supreme Court, but inherent in them will be constitutional dignity. It will be a constitutional message to the highest court in the country. Political or signature campaigns have no legal or constitutional sanctity. Name one event empirically in India or in the rest of the world where signature campaigns have altered legal interpretations. They are not even admissible. Assembly resolutions reflect the will of the people unambiguously.

Signature campaign for independence was carried out by Yasin Malik also. How far did that campaign go.

And incidentally CM sahib you derive your power and perks and Chief Ministerial position from Assembly. Why show such disregard disdain and contempt for the very institution that has made you the CM..

I was reading the yesterday’s court proceedings and for all practical purposes the Supreme Court has reasserted its assent to creation of Ladakh as a UT.

I don’t want to score brownie points. But I am asking you CM sahib —- where were you sleeping. Where was your government sleeping. Why didn’t you ensure that some sort of a resolution is sent to the Supreme Court. It was your duty. You are the CM. Are you the CM just to enjoy the perks of power and not accept the responsibility that comes with it. And instead of showing remorse for being late in passing a resolution, you want to bypass it yet again.

I beg you. Please stop this childish and immature attitude. We will support any campaign unconditionally. But please ensure that a resolution from the state assembly is also passed and sent to the Supreme Court.

We are facing a battle of a lifetime. Door to door signature campaign is nothing but theatrics. Tell me is Supreme Court answerable to majoritarian assertions or to law. Majoritarianism is something which we politicians practice. Supreme Court practices law. Please don’t start a process in which we may end up being seen as trying to scare Supreme Court by majoritarian muscularity. Signature campaign or an Assembly resolution. Which one is the more dignified way to approach the Supreme Court.

I would strongly assert that pass a resolution in the state Assembly. That is the most dignified way to approach the Supreme Court. Don’t set the stage for denial of statehood. Act like a leader. Don’t throw tantrums. There seem to be no takers for tantrums. Act your age and stature. Put an end to theatrics. This is a real ideological battle. This is not a video game.

And before I end. Please tell me. Are you shielding and protecting the state BJP and giving them the luxury of not taking a position on statehood, by not passing a resolution on statehood.

Can the government explain its inability to release MLA funds and yet have the audacity to attach a JD Finance. Scapegoating is an old NC trait. But this is stretching it too far.

First sin was this officer seems to be the son of being a Kashmiri. The second sin of course was that he was extremely talented.

Finance department requires skilled people to run the department. It can’t be run on likes or dislikes or whims. A non finance man cannot run it. We have a minister in charge who is from a non finance background and is anything but skilled.

Needless to add, finance department is the engine of the government and importantly the engine of the Kashmiri economy which has a high proportion of public spending.

Please put your house in order. Let skill decide postings and not cronyism. An unsolicited advice to government. You desperately need talented people. I wouldn’t have advised you. But you are going to drown the whole boat of governance. You will go down in history as a unique government who so much excelled in inefficieny that they drowned the opposition along with their government

RESERVATIONS

I have all along maintained that the government is clueless on reservations and has no intentions of doing anything.

Now coming to this draft proposal. To the best of my knowledge anything sent to cabinet should be vetted by the law department. It is not the other way round.

You can’t send something to cabinet which is outside the domain of law.

It looks like another round of time wasting tactics.

The model of democracy that we are following is the British Model.

The British with all their expertise couldn’t invent a situation where a party can simultaneously be the ruling party and the opposition party. The NC attempted that impossible feat over the last 3 days of Assembly.

They have a brute majority. More than fifty of them held the entire Assembly to ransom. An ugly blend of cacophony and cantankerousness ensured that the Assembly was repeatedly adjourned.

The MLAs in age groups of 40 to 50 to 60 to 70 years were merrily jumping around, climbing tables, making the Assembly resemble a Nursery school. They were shouting slogans, laughing, and whiling away time like Nursery goers.

It was a free for all and scenes from the assembly resembled overgrown ugly uncles almost vandalising the assembly, shouting, sloganeering and being bad boys tearing to shreds any piece of paper they could lay their hands on and throwing them in the air.

And the speaker looked like an unworried principal, seemingly in know of when and how the “song and dance performance” will end.

The overgrown uncles and the unworried principal seemed to be in a state of argument. The unworried principal wore a forlorn look, would occasionally smile, stretch his neck, take a peep around, smile and then announce adjournment. He was bad at pretending. He pretended to be lost which he never was.

After three days of vocal rampage by the overgrown uncles, the unworried principal was miraculously allowed to make a speech, followed by yet another round of cacophony and now finally followed by the unworried principal calling it sine die.

NC brings in a adjournment motion on Wakf and the Speaker who incidentally is an NC member and is the Speaker at the pleasure of these very members, refuses to allow any discussion and says it is sub judice.

The tiny Kashmir based oppostion proposes a no confidence motion against the speaker in reaction to his refusal to allow any discussion of any sort on Waqf bill.

The same shouting NC brigade refuses to support the no confidence motion.

NC has the majority and by virtue of this majority have a Chief Minister, a speaker and a cabinet. They run the government, they enjoy all the perks of power. The onus of having a discussion on Wakf was on the majority.

Is it the speaker’s fault. But is the speaker bigger than the Waqf bill. They could have removed him and got a new speaker who would facilitate the discussion on Waqf.

So is this majority only to enjoy power. Is this majority not to be used when a powerful message has to be sent —that we are Muslims and will not accept any interference in our religious affairs.

Being in power does not mean enjoying power alone. It comes with a set of responsibilities. So NC is okay with enjoying power but is not willing to fulfill its responsibilities.

As much as you use noise as a weapon, the truth stares in our faces. NC sabotaged the Wakf discussion. And used noise and bedlam to camaflouge the mother of all betrayals. — THE WAKF BETRAYAL

My dear kashmiris.

The shouting brigade was NC
The speaker was NC
The tulips were NC

Anyone can go to the court and enact yet another theatrical performance. But the will of the people of J and K vests in the Assembly. That milestone in history that event of the only Muslim Manority province of India lending its support to fellow Muslims in the country and opposing the draconian Waqf bill is lost for all times to come.
