It Is confirmed: Indiana Federal Firearms Licensees (licensed firearms dealers) can now sell firearms to Indiana residents who hold an Indiana License to Carry Handgun ("LTCH") without a background check conducted by the National Instant Criminal Background Check System (NICS), if the LTCH was issued within the last five years. This applies to all Indiana five-year LTCHs. It also applies to Indiana lifetime licenses if the license was issued within the five years preceding the sale.
Note: if you currently have a lifetime LTCH obtained more than five years ago and would like a five-year license to avail yourself of potential firearm purchases without a NICS check, Indiana law allows you to hold both licenses at the same time. You can apply for a 5-year license like you're applying for a new LTCH at: https://t.co/cCESGmXzNu . Your new application or the issuance of your five year LTCH does not affect the validity of your lifetime license.
If you hold a lifetime license and you submit an application for a new five-year LTCH, I am told by ISP that they can use you same electronic fingerprints that you submitted for your original license for your new application. Older paper prints (like I submitted 20+ years ago) cannot be used for the new application - we have to make an appointment to get new electronic prints. You can do that as part of the application process. There is no fee for the new license, except for fingerprinting services.
Also please note that an Indiana FFL can still insist on conducting a NICS check as a condition of sale even if your LTCH meets the requirements for a NICS-exempt sale. That is totally the store management's discretion.
You can see the ATF's "open letter" to FFLs on this issue here:
