ICYMI:
Sometime in early 2024, Oregon State Police changed their Firearms Transper Policy in the FICS (Firearms) Unit and began DELAYING people with convictions set aside under ORS 137.225, and upon a delayed challenge they were DENYING the transfer.
Both state and federal law allow a restoration of firearms rights with a set-aside.
OSP tried to claim that people with set asides weren’t covered, that we were FEDERALLY disqualified, and that we didn’t have “jury rights back”, so we weren’t covered by “civil rights restoration” either.
We were told to appeal with the FBI.
I was one of these Delay/Denials.
I said “Fuck You, No” and hired an attorney.
To further prove my point I purchased 2 suppressors, which undergo an ATF/FBI background check, and skip OSP. I was approved for both in RECORD time!
This confirmed my suspicion that OSP was taking a FBI approval, and changing it to denied!
After OVER a YEAR battling, we won in the Circuit Court for Marion County in Oregon.
I found out today that OSP will not appeal the decision, and while we didn’t get declaratory relief for everyone, OSP has yielded and changed their policy to reflect our judgement!
Huge Win!
TLDR: If you had a set aside conviction in Oregon, and were delayed or denied a firearm transfer with a clean record, YOU’RE CLEAR NOW!

I’ve recently heard of a couple people that were previously impacted by OSP’s unlawful set aside policy, and they’ve been able to purchase without issue!
I checked in with my attorney today and let him know. He got confirmation today that “OSP is not appealing the victory and they’re internally changing their entire policy consistent with our judgment.”
We’ve won folks!
If you’ve been delayed or denied due to a set aside record, you’re good to go now! Go rerun or attempt again!

@ATFHQ So re-register my individual suppressor so my spouse can touch it too?
What if married couple’s divorce, who gets the suppressor? Do they share it still?
How about delete the NFA registration and the illegal regulation.

@lydiakauppi@Chefboi_JD@JustinBGalloway As an adult I understand they are straight, but a small child doesn’t know the concepts of gay vs straight.
The point is that the whole Pride thing is very vocal about stating “gay and lesbian” etc.

Kids aren’t then confused going “Mommy what’s straight mean?”
