Dear Young Lawyers:
I have observed that many of you do not keep Practice Notes because you believe that judicial authorities are now easily accessible through technology. Instead of building your Practice Notes ahead of time, many of you simply wait until you are assigned a research task or asked to draft a court process before you begin looking for authorities.
I started keeping a Practice Note in 2010, filling 4 volumes with handwritten summaries and excerpts of principles from law reports before eventually transitioning to writing in longhand on my iPad. Whenever I have a challenging brief or need to prepare for a contentious matter, I consult my notes first, and this usually makes my work easier.
A former colleague, now a High Court Judge, kept their Practice Notes in Microsoft Word format as far back as fifteen years ago. Lawyers who appear before the Judge often commend the Judge’s brilliance, and it doesn’t surprise me. It is difficult to maintain detailed notes on rulings, statutory interpretations, and procedural objections over several years without developing an exceptional command of dispute resolution.
Relying entirely on electronic legal research engines or artificial intelligence tools allows a practitioner to retrieve a judicial authority in seconds, but it cannot substitute for the personal retention that develops when you read a judgment in full and record the principle yourself. When you are on your feet in the courtroom responding to an unexpected objection from opposing counsel, the notes you have digested remain accessible to you in a way an unread search result never can. It will also prevent you from asking for an adjournment or a stand-down just to respond to an unexpected argument from opposing counsel.
If you have not been taking notes since you started practice, it is not too late to begin now.
Wow... the legal profession’s pushback on AI is starting to get a lot more serious. 👀
And this one is very interesting.
A Florida lawyer is facing possible sanctions for suspected AI use even though there were no fake cases or hallucinated citations.
The cases were real. The citations were real.
The court’s issue was basically: did a lawyer actually think through and write this?
In Lisandrillo v. Palozzi, the 4th DCA tore into a series of filings in a divorce/custody case, calling them unfocused, scattershot and, at points, basically gibberish.
Judge Robert Gross wrote:
“An AI supercomputer would struggle to find meaning in some of the prose used in this case.”
The court suspected the filings had been put together using AI instead of through the lawyer’s own independent professional judgment.
It then ordered the lawyer to explain within 10 days, specifically WITHOUT USING AI, why she shouldn’t be sanctioned or referred to The Florida Bar.
The lawyer has publicly denied using AI to generate the filings.
The underlying message from the court seems pretty clear:
Using AI isn’t a defense for bad lawyering, and even technically accurate AI-assisted work can become a problem if it looks like nobody exercised actual legal judgment.
I think we’re going to see a lot more of this.
The legal profession is starting to push back on AI use in a much more fundamental way than just “don’t hallucinate cases”!

DAY 2/36
THE ART OF CROSS-EXAMINATION
Chapter 1: Introductory
A trial lawyer’s real skill is tested in the courtroom—not merely in the library.
Wellman observes that modern jurors generally give careful attention to testimony and seek the truth. This makes the lawyer’s ability to conduct a trial effectively especially important.
But there is another important lesson:
Knowing the law and knowing how to conduct a trial are not the same thing.
Trial advocacy is a distinct skill—one that develops through actual courtroom experience, preparation and practice.
For an advocate, learning the law is the foundation.
Learning how to try a case is another art altogether.

There comes a time when the statute of limitations passes. But there doesn't come a time when you get the identity of the other person you're wrongly using and you can therefore use it. https://t.co/xn0b9xLkia (h/t @EWess92)
