🚨When someone challenges how a public office was filled, which court should they turn to? Is it the Employment Court or the High Court? For years the courts gave conflicting answers.
The Supreme Court in the case of Moi Teaching & Referral Hospital v Dr. Magare Gikenyi & 76 Others (E030 consolidated with E033) has now settled it, and in doing so corrected the very test the lower courts had been using.
Some citizens challenged the appointment of CEOs and managing directors of four state corporations, alleging ethnic bias and a lack of merit. The State objected and stated that recruitment is an employment matter, so it belongs in the Employment and Labour Relations Court under Article 162(2)(a) of the Constitution and Section 12 of the ELRC Act, not the High Court.
The High Court and Court of Appeal both used one test: no employer–employee relationship existed, so the Employment Court had nothing to hear. The Supreme Court held that test was wrong. Reading Section 12 of the ELRC Act together with the Employment Act, the Labour Relations Act and the Labour Institutions Act, the word "including" is not exhaustive and these laws expressly protect persons seeking employment, not just employees. So pre-employment disputes (advertising, shortlisting, interviews, selection) fall within the Employment Court's exclusive jurisdiction.
But the case turned on capacity. The petitioners weren't job applicants. They sued as citizens under Articles 3(1) and 22 of the Constitution, defending the rule of law which is a public-law question properly before the High Court under Article 165(3)(b) and (d).
Key takeaway: The dividing line is no longer "was there an employment relationship?" It is the nature of the dispute and the capacity of the party suing. A rejected applicant goes to the Employment Court; a citizen challenging the constitutionality of a public appointment goes to the High Court.
