NELF is thrilled to announce a key win in Morse Brothers, Inc. v. Town of Halifax. The Massachusetts Superior Court ruled in favor of the cranberry grower, striking down unlawful restrictions imposed by the town on essential sand removal for cranberry cultivation.
NELF’s October 2024 amicus memorandum argued that such land use is protected under Massachusetts zoning law. The court agreed, finding the town’s actions unreasonable and unsupported by law or evidence.
This landmark victory underscores NELF’s vital role in defending property rights and upholding the rule of law. 💪⚖️

NELF has filed an amicus brief urging the U.S. Supreme Court to review Crownholm v. Moore—a case defending the right to work and sell information without excessive government interference.
Ryan Crownholm, who sells real estate site plans created from public data, was cited for allegedly practicing land surveying without a license. NELF is standing up for his First Amendment right to free speech and entrepreneurship.

NELF has filed an amicus brief in the Massachusetts Supreme Judicial Court, supporting the Town of Milton in Attorney General v. Town of Milton (SJC-13580). This case challenges the enforceability of zoning "guidelines" issued by the Executive Office of Housing and Livable Communities (EOHCL) under the MBTA Communities Act.
Our stance? 📢 These guidelines are unenforceable because they were not properly issued under the state's Administrative Procedures Act (APA). The APA ensures that important regulations, like those affecting housing, are subject to public input and transparency.
At NELF, we believe in promoting fair, transparent government processes—and this case is a crucial step in protecting those principles.
