#NIL Contract Review Tip: Watch for "sole discretion" language. Universities often draft contracts giving themselves unilateral decision-making power, including termination rights, at their "sole discretion." When possible, push to change this to "reasonable discretion" and/or add similar constraints. This small edit might seem minor, but it can be crucial if a dispute arises, as it requires the university to justify its decisions rather than act arbitrarily.

1. Rev share payments can be offset by third party NIL $ secured by a school, but the school’s cap hit is not reduced.

2. Athletes can be paid NIL $ to promote events in which they participate (MTEs, bowl games, etc.).
