Before allegedly exposing himself to a woman and trying to abduct another woman at a park, WJLA found that illegal immigrant Rico Rosales faced drug charges in 2024.

Detectives said they caught Rico Rosales selling fentanyl pills.

State law requires people who are convicted of selling fentanyl to serve a minimum of five years in prison. Those convicted face up to 40 years behind bars with fines up to half a million dollars.

But according to court records, Fairfax County Commonwealth's Attorney Steve Descano’s office dropped the drug charges. And when ICE lodged an immigration detainer, ICE says Sheriff Stacey Kincaid ignored it.

Rico Rosales was also charged with robbery last year. Descano’s office amended the felony to a misdemeanor. And Both charges were dismissed.

Sean Kennedy with Virginians for Safe Communities says all of this is another example of how Descano’s office appears to be lenient on criminal illegal immigrants.

EXCLUSIVE: The U.S. Department of Homeland Security told 7News Reporter Nick Minock that ICE issued an immigration detainer against illegal immigrant Moises Domingo Rico Rosales, who is currently charged with abduction with the intent to defile and indecent exposure in Fairfax County.

“This criminal illegal alien exposed himself to one woman in a park and then attempted to abduct another woman the same day,” DHS Acting Assistant Secretary Lauren Bis said.
