In Juhapura, Ahmedabad, Gujarat, a 70-year-old man identified as Zaheer Shaikh died after being taken into police custody, leading to serious allegations of custodial torture and conflicting claims from police and family members.

Zaheer Shaikh had reportedly been arrested in connection with a case involving alleged possession of around 500 kg of beef. Earlier, videos showing police action against some accused in the case had circulated widely on social media.

Before his death, a video recorded by his son surfaced online in which Zaheer claimed that police personnel assaulted him in custody. In the video, he alleged that officers beat him, pulled his beard, kicked him in his private parts, and demanded money as a bribe. He specifically named an officer identified as Akshay in the recording.

Family members and local residents have alleged that Zaheer was subjected to custodial violence and abuse. According to them, he named several police personnel before he died while undergoing treatment at SVP Hospital in Ahmedabad.

Police, however, have denied the torture allegations and stated that Zaheer’s condition deteriorated after he allegedly consumed a high dose of medication while in custody, which they say led to his hospitalisation and subsequent death.

Justice Krishna Iyer's dictum was laid down in 1977. It may be perhaps found only in textbooks and presumably not applicable to real cases and real accused.

The Trial Courts seem to think that 'we shall oblige the police and send the accused to jail and let the accused secure bail from the higher Courts (HC and SC).

This is abdication of duty. If the Trial Courts did their work and applied the law, the burden on the High Courts and the Supreme Court will reduce considerably

And so many thousands of under-trials will not languish in prison without charges being framed, without a trial and without a punishment

अहमदाबाद के जुहापुरा से एक हफ्ते पहले 500 किलो गौमांस के आरोप में पुलिस ने कुछ मुस्लिम युवाओं को गिरफ्तार किया, जिनकी लाइव पुलिस पिटाई की वीडियो भी खूब वायरल हुई!

आरोप था कि यह “माल” बीफ व्यापारी ज़हीर शैख़ उर्फ ज़हीर डब्बा का है। पुलिस ने 2 दिन पहले 70 वर्षीय ज़हीर डब्बा को गिरफ़्तार किया और आज पुलिस कस्टडी में ज़हीर की मौत हो गई।

आरोप है की पुलिस ने ज़हीर को पीटा, उसकी दाढ़ी खींची, पेशाब की जगह पर लात मारी और पिटाई ना करने के लिए पुलिसवाले ने 1 लाख रुपये की रिश्वत मांगी!

बहरहाल अहमदाबाद के SVP अस्पताल में ज़हीर ने आख़िरी सांस ली और मरने से पहले ऑन कैमरा कई पुलिसवालों के नाम लिए जिन्होंने टॉर्चर किया था।

उधर पुलिस का कहना है की ज़हीर ने कस्टडी में दवाई का हाई डोज़ लिया इसलिए उसकी तबीयत ख़राब हुई थी। अब सवाल यह है की जो व्यक्ति पुलिस कस्टडी में है उसके पास इतनी सारी दवाई आई कहाँ से?

इससे पहले भी जुहापुरा से कस्टोडियल डेथ के मामले सामने आए हैं और मोदी काल में “गुजरात” कस्टोडियल डेथ में टॉप पर है!
