CAN A LANDLORD INCREASE RENT EVERY YEAR?

Generally, there is no single law in Nigeria that prevents a landlord from increasing rent. However, a landlord cannot increase rent without giving a notice of rent increment.

Also, there is no specific law that states the exact amount by which rent can be increased, since rent is usually based on the agreement between the landlord and tenant. However, the increase must be fair and reasonable.

Under the Rent Control and Recovery of Residential Premises Law(RCRPL), which applies to certain areas such as Apapa, Ikeja GRA, Ikoyi, and Victoria Island, a landlord can only increase rent once every two (2) years and must give written notice at least six (6) months before the tenancy expires.

When a tenant receives the notice, they can accept the new rent, negotiate, or refuse it. If the tenant refuses, the landlord may follow the legal process to recover possession of the property.

In other parts of Lagos State, under the Tenancy Law of Lagos State 2011, rent must be fair and reasonable. If a tenant believes the increase is too high, they can challenge it in court(Section 37 of the Tenancy Law of Lagos state, 2011).

Since tenancy laws differ from state to state, it is important to check your tenancy agreement. A rent review clause which is contained in the Tenancy agreement may state when and how rent can be increased.

10 COMMON STATEMENTS YOU SHOULD NEVER MAKE CARELESSLY

1. "I WILL DEAL WITH YOU."
Such a statement may be interpreted as a threat, especially where there is conflict.

2. "YOU WILL NOT LEAVE HERE ALIVÉ." Even if said in anger, such a statement can create serious legal problems. If anything happens to that person, the maker of the statement should be ready to give an account.

3. "I KNOW PEOPLE WHO CAN MAKE YOU DISAPPEAR."
Threatening a person's life is a crime in Nigeria and this statement may expose the maker to criminal liability.

4. "I WILL MAKE YOU LOSE YOUR JOB." Repeated threats like this accompanied by harassment, blackmail or intimidation can expose the maker to liability.

5. "THAT CHILD IS NOT HIS."
Under the law, he who alleges must prove. You may be invited to present proof of such an allegation and remember, adding "allegedly" to a post does not absolve one from liability.

6. "SHE SLEPT HER WAY TO THE TOP." This kind of statement has the tendency to lower a person in the eyes of the public. An action for defamation may be instituted against the maker.

7. "HE IS A RIT¥ALIST."
Accusing someone of such acts without evidence is risky.

8. "THAT BUSINESS IS A SCAM."
Before making such claims publicly, be sure your facts are backed by evidence.

9. "SHE STOLE THE iPHONE AT THE PARTY."
Accusing someone of theft without proof can lead to legal trouble.

10. "EVERYBODY KNOWS HE IS A CRIMINAL."
Spreading rumours about someone does not protect you from liability if the statement is false.

Words are powerful.

A statement made in anger, or as a joke, can still lead to legal action against the maker.

Before you speak or post anything about someone, ask yourself one question:

Can I prove it?

If you cannot prove it, it is wise to refrain from doing so.

Important Documents you must ask for before buying land in Nigeria

1. If the person says that the land was gifted to him, ask for a Deed of Gift.

2. If the person says that he bought the land, ask for Deed of Assignment, Deed of Conveyance or Irrevocable power of Attorney.

3. If the person says the land was shared between him and someone else, ask for Deed of Partition.

4. If the person says that he is holding the land in trust for a minor, ask for Deed of trust.

5. If the person says that the land is a family land, ask for written consent of the family head and principal members of the family or the family resolution.

6. If the person says he inherited the property without a Will, ask for the Letters of Administration.

7. If the person inherited the land from a late person who made a Will, ask for the grant of probate or Deed of Assent.

Buying land is not something you should do in a hurry, ensure that you conduct due diligence before you make payment.
