This ruling highlights a complex and evolving tension between the rights to equality, dignity, and non discrimination for transgender persons, and concerns grounded in fairness, morality, and societal understandings of sex and gender.

From a human rights perspective, the challenge is not simply to privilege one set of interests over another, but to develop legal frameworks that respect the dignity of all individuals while ensuring that any restrictions on participation are evidence based, proportionate, and objectively justified.

In my view, continued dialogue informed by scientific, medical, legal, and social perspectives remains essential. Where credible scientific and medical evidence recognizes an individual’s gender identity as differing from that assigned at birth, such evidence should carry significant weight in legal and policy discussions. Ultimately, the objective should be to foster inclusive societies in which the rights and dignity of every person are respected.

The disturbing scenes emerging from South Africa, including reports of beatings, looting, intimidation, and the forced displacement of African migrants, should concern every believer in human dignity and Pan African solidarity.

States undoubtedly have the sovereign right to regulate migration and address irregular migration. However, no individual, regardless of their immigration status, loses their humanity. International human rights law is unequivocal: every person is entitled to fundamental rights, including the right to life, dignity, security, and freedom from violence and degrading treatment.

Migrants, whether documented or undocumented, must never become scapegoats for broader socioeconomic challenges. History teaches us that xenophobia undermines social cohesion, weakens the rule of law, and erodes the values upon which democratic societies are built.

As I argued in an earlier post, Africa’s future cannot be built on exclusion and violence. It must be grounded in the principle of Ubuntu, the recognition that our shared humanity binds us together.

As Africans, we must reject xenophobia in all its forms and insist that migration governance be pursued through lawful, humane and rights based approaches.
