An employee has been awarded Kshs. 8,190,000 against Lexo Energy Kenya Limited after ELRC held that his sudden dismissal completely unlawful! The company had fired its Head of Retail, Sammy Maundu, citing an “irretrievable breakdown in the working relationship” but the court wasn’t convinced. Justice Linnet Ndolo found the termination both substantively and procedurally unfair, pointing out that there was no valid reason and no disciplinary hearing.

While Maundu secured a hefty 10-month salary compensation plus full costs, the court drew the line on his USD 913,745 claim for staff share options. Those shares were linked to Lexo Energy Mauritius Limited, reinforcing a key corporate law principle: a parent company remains a separate legal entity and cannot be dragged into a subsidiary’s employment dispute.
