This footage is going to become a big headache for the police.

A police officer appears to pretend he has been hit by a car.

Seconds later, the elderly man behind the wheel is dragged out of the vehicle and thrown to the ground.

How are the public supposed to trust the police to enforce the law when incidents like this happen?

This needs investigating properly, and if the footage is as it appears, there must be accountability for every officer involved.

Has to be political - Mr Somerville had no history of offending the court noted only one previous motoring offence yet he has received two years in prison for violent disorder. The separate allegation of assaulting a police officer has not been proved and is still to be dealt with by the magistrates.

Violence against police must absolutely be punished. But as a former magistrate, I have serious questions about proportionality and consistency here.

The judge said the sentence would act as a deterrent to others. Sentencing should punish the offender for the offence committed, while deterrence is a legitimate sentencing consideration but justice must remain proportionate to the actual conduct and the individual’s circumstances. When someone with virtually no criminal history receives two years for this conduct, it is entirely reasonable to ask whether the sentence is proportionate when compared with sentences imposed for other serious offences.

Justice must be consistent, proportionate and based on the evidence not on making an example of someone because of the wider political circumstances.
