Lemon Law attorney for 20 years. NY/NJ. When not keeping auto manufacturers honest I’m probably fishing, playing Risk, or watching my kids play sports.
These clauses can drastically inhibit consumer Lemon Law recourse options. They do typically provide an “opt out’ - but almost nobody is aware and actually exercises that option.
If the dealer model goes away - politicians are going to need to address that problem.
I agree with this sentiment. Dealerships add little value these day on the sales end.
That said - there is an important consumer protection point here. Manufacturers which sell direct to consumer are able to insert arbitration clauses into the sale and lease contract. (1/2)
Why do I have to go through a dealership to buy a car? I should be able to go online, pick the exact model, color and features I want, see the actual price, pay for it and have the car delivered to my driveway. Why do I need to spend half a day negotiating with a middleman just to buy something I already know I want?
Don’t like it when BMW pipes ads into your ‘luxury’ car?
Just wait until its engine dies and they blame some made up ‘impact damage’ underneath the vehicle while suggesting you call your insurance company.
Trash company? You decide.
seems crazy.
The movie Spider-Man: Brand New Day paid BMW to take over the display of every BMW made after 2020.
When you start a BMW, it shows you an ad for Spider Man. Really cheapens BMW imo.
@_brett_grant_@JeepCares@Jeep The dealer is required to provide you with a repair order per the NYS Repair Shop Act. If they won’t, you can file a complaint with DMV which regulates licensed repair shops in NY.

Stellantis and Jaguar Land Rover? We’re about to see BIBLICAL levels of unreliability. We’re going to see Lemon Law cases like we’ve never seen before.
This is like EA and Ubisoft partnering up to make a video game.
#Stellantis and Jaguar Land Rover (JLR) have signed a MOU to explore collaboration opportunities in product development in the U.S.
By combining complementary strengths across product & technology development, we will create new synergies and deliver value for both organizations.
@f2aler Yup, there are all kinds. The main thing is very occasionally you will get a client where it's not going to work - and the best thing you can do is figure that out sooner rather than later.
Seems to me that outsourcing intelligence can be a double edged sword. There are obviously some great things it can do - but used incorrectly it actually wastes time. People are getting sick of that.
Had a potential client recently who would not (or could not) answer a direct question regarding the problems he was experiencing with his vehicle. Kept sending me pages of ChatGPT output which were relevant to his case - but didn't actually answer my question.
@elonmusk Hilarious. Took a break from reviewing a potential Cybertruck LL case and this is the first tweet I saw. But to be fair, we don’t get a lot of Cybertruck leads.
