Subject: Complaint Regarding Potential Conflict of Interest – Appointment to Immigration Advisory Board

Dear Public Protector,

This letter serves as a formal complaint concerning a potential conflict of interest in a public appointment made within the Department of Home Affairs (DHA).

Around April 2025, the Minister of Home Affairs, Dr Leon Schreiber, appointed Ms Stefanie de Saude-Darbandi of De Saude Sadat Darbandi Immigration Attorneys Inc. as an independent member of the Immigration Advisory Board. This Board is mandated under section 4 of the Immigration Act 13 of 2002 to advise the Minister on immigration policy and related regulatory matters.

The conflict arises from the fact that Ms de Saude-Darbandi’s law firm specialises in immigration law and has, on multiple occasions, successfully challenged the DHA in court, particularly regarding delays in application processing. Court records, including the Supreme Court of Appeal judgment in Director-General of the Department of Home Affairs and Others v De Saude Attorneys and Another [2019] ZASCA 46 and subsequent High Court matters, indicate that her firm has consistently highlighted and derived financial benefit from the systemic inefficiencies within the Department.

This appointment therefore presents a significant conflict of interest: the Minister is responsible for reforming DHA dysfunction, yet he has appointed a practitioner whose firm profits from litigating over that very dysfunction. Furthermore, the appointee is now positioned to advise on policy while her firm continues to pursue legal action against the same department.

In light of the above, I request that your office investigate this matter as a potential case of improper conduct in state affairs or public administration.

Members of the public are being warned about an alleged employment scam involving a woman identified as Nodolly Machristmas Mazibuko, also known as Grace.

According to the complainant, the suspect allegedly promised victims employment opportunities at Sebokeng Hospital in exchange for money. It is further alleged that a fraud case has been opened against her.

Anyone who believes they may have fallen victim to the alleged scam is urged to report the matter at their nearest police station and provide all relevant evidence to assist with the investigation.

The public is encouraged to share this warning to help prevent others from becoming victims.

My source has confirmed that the Nigerian man, Francis Chukwudike, who was mocking Zulu culture, lives in Cape Town. He reportedly arrived in South Africa on a student visa in 2009 and now owns a club and several businesses.

He has allegedly been wanted by Nigeria's Economic and Financial Crimes Commission (EFCC) since at least 2021 for cyber-related fraud.

The charges reportedly include criminal conspiracy, computer related fraud, and obtaining money by false pretences, among others, alongside several other individuals who were declared wanted at the time.

He was declared a fugitive, and reports claim that he has been living openly in South Africa, including in Cape Town and Sandton, despite the warrant. Reports also mention past incidents involving unpaid bills at various venues.

Home Affairs is failing this country. 😩😩
