Also, VicForests thought a newly amended definition of the precautionary principle within its own Code could be understood 'a different way' 3/4
The judge notes how in its appeal in the earlier Leadbeaters Possum case (2020), VicForests succeeded on only 1 of 31 initial grounds, relating to the EPBC Act.
In fact, VicForests has now been found to be in breach of the same Code provision in two separate court cases. 2/4
