Avelino v. Cuenco (1949) upheld a 12-senator quorum to continue proceedings after a walkout under the 1935 Constitution, which lacked any explicit “majority of all members” rule for leadership elections. The 1987 Charter deliberately strengthened that threshold. Avelino therefore cannot be stretched to validate officer elections cast with only 12 votes.
The June 3 reorganization by the 12-senator bloc therefore lacks constitutional authority. Legarda’s textual argument is stronger and decisive. Political momentum and institutional recognition may give the new arrangement de facto force, but they do not cure the defect in the vote count. The proper forum to settle the resulting legitimacy gap is the Supreme Court or a negotiated return to the full Senate’s constitutional process.
