"A remarkable ruling from the Employment Appeal Tribunal last week has revealed that NHS Trusts can now delete 90,000 emails in the middle of a court hearing, deny the existence of board meeting minutes (until they're discovered behind the photocopier), and feed tribunals a diet of whoppers—with absolutely no consequence whatsoever. This now from a High Court Judge who threw out an appeal from Dr Chris Day challenging an earlier Employment Tribunal decision that ignored all this and many other things.
In the long-running saga of Dr Chris Day, the resident doctor turned whistleblower who dared to challenge the culture of cover-up in NHS management, the EAT acknowledged that the Respondent Trust's behaviour was indeed "troubling"—but surprise surprise, not quite troubling enough for the Judge to do anything about it or for Dr Day to win his appeal."

I will be releasing a final written position on all of this. It has currently and helpfully been placed before the EAT President by his private secretary and I will include his comment also when I have it.
It is obvious what had gone on here with the barristers involved in representing me and the NHS back in 2018 and these actions have obstructed justice.
That is what has caused this extraordinary mess and the world of employment law keeps digging.

@theRCN The biggest barrier for nurses at the moment is having a union that doesn't represent it's members.
They took the pay spine nonsense to the last negotiations without it being the members requesting it, then told staff the dreadful offer was the best they'd get.

RCN members used their democratic vote instructing Council not to participate in the PRB. By ignoring this & agreeing to participate in the 'not' independent PRB the RCN in effect accepted that no pay award would be made in April. As you say Nursing Pay is deliberately undermined
Nursing staff are reporting that staffing levels are impacting on patient safety. We need to follow the example of other countries such as Australia and the US and introduce Nurse/Patient Ratios now.
