Okay, so the RDW has responded to the statement about FSD approval in The Netherlands 🇳🇱

Here’s what I make of it:

Tesla stated that “Currently, RDW has committed to granting Netherlands National approval in February 2026.”

This is what the RDW responds to this statement in their latest press release

“Wel kunnen we vermelden dat de RDW met Tesla een planning heeft opgesteld waarbij Tesla naar verwachting in februari 2026 kan aantonen dat FSD Supervised aan de vereisten voldoet. RDW en Tesla weten welke inspanningen geleverd moeten worden om hierover in februari een besluit te nemen. Of de planning gehaald wordt, moet de komende periode blijken.”

Effectively they acknowledge that indeed the Article 39 path is being taken and that in fact RDW is closely cooperating together with Tesla in showing FSD is safe enough to be granted the exemption. Both parties know what is expected of them and what they need to show in order for a decision to be made.

However, it’s not set in stone. Not just yet.

The positive thing is that the wait for @UNECE is over and that in fact Article 39 exemption is the most feasible option and quite possibly also the only option Tesla is currently pursuing

This also means that WHEN granted the exemption, FSD will become the standard and regulators will NEED to accept FSD as a benchmark instead of ignoring it and boycotting it

Thus, FSD will be shaping policy and regulations and not the other way around

Tesla has been working hard toward shipping Full Self-Driving (Supervised) in Europe for over 12 months now. We have given FSD demos to regulators of almost every EU country. We have requested early access, pilot release programs or exemptions where possible.

We have developed & shared detailed safety evidence for FSD, now public in our latest Safety Report. And we have driven over 1 million kilometers safely on EU roads across 17 different countries (internal testing). 

Our main path to success is partnering with the Dutch approval authority RDW to gain exemption for the feature. This involves proving compliance with existing regulations (UN-R-171 DCAS) + filing an exemption (EU Article 39) for yet-to-be-regulated behaviors like Level 2 systems off-highway, system-initiated lane changes with hands-off the wheel etc. 

Some of these regulations are outdated and rules-based, which makes FSD illegal in its current form. Changing FSD to be compliant with these rules would make it unsafe and unusable in many cases. While we have changed FSD to be maximally compliant where it is logical and reasonable, we won't sacrifice the safety of a proven system or materially deteriorate customer usability. 

As a result, we are gathering evidence to get exemptions on a specific rule-by-rule basis. Unfortunately, the real world fleet-proven safety wins alone are considered insufficient.

European regulators are terrified of Tesla FSD Supervised, while on every road half of the Netherlands is driving with a phone in their hand.

And yes, Tesla’s lead is starting to become painful. Millions of cars collecting real data 24/7, end-to-end neural networks, vision-only that already outperforms the rest’s lidar combos, and every few weeks an update that actually makes it smarter.

The competition is still messing around with Level 2 tricks. Tesla has long been playing on a different level.

In short: scared of a system that requires an attentive driver, while the real danger is just out there scrolling. Irony level 1000. 😂⚡️
