All of a sudden overnight everyone is an expert on the insanity defense and NGRI pleas and verdicts. It's that sudden expertise they enjoy automatically overnight. No matter the subject everyone qualifies as an expert. Whenever they say. Whether the subject is history or criminal jurisprudence or medicine or the sudden dread of seed oils, you can bet your bottom dollar that social media scrums will rise to the occasion burnishing their newly minted EXPERT badges.

But here goes. Reality.

The insanity defense is neither common nor commonly successful in American criminal law. It is raised in only a tiny fraction of criminal cases and succeeds in only a fraction of those. The popular image of dangerous defendants routinely claiming madness and walking free is unsupported by evidence. Moreover, an insanity acquittal does not ordinarily mean immediate freedom. Defendants are frequently committed to secure psychiatric institutions, sometimes for periods exceeding the sentence available after conviction. But who cares? I know, I know.

Mental illness alone is insufficient. (Say that again to yourself.) The law demands proof of a severe disorder that disables someone to appreciate the difference between right and wrong. It's not enough that you're crazy; you have to be unaware that the behavior exhibited is wrong. Got that? You have to not understand the concept of it being illegal or immoral or whatever you want to call it. Postpartum depression alone won't cut it. Psychotic delusion won't either. Capeesh?

The facts expose the mythology. Insanity is an exceptional defense.
