The Bar of Northern Ireland has urged the Department of Justice to stabilise the Legal Aid system, a system in crisis as a result of long standing underinvestment and the continued failure of the DoJ to conduct renumeration reviews when required to under statute.
The statement from Bar Council Chair Donal Lunny KC follows a Ministerial Statement made by the Justice Minister to the Northern Ireland Assembly yesterday (02 Dec.) on reform proposals relating to the provision of Legal Aid.
The Department's proposals are described by the Bar as placing ideologically driven policy experimentalism ahead of achieving stability in our system of Legal Aid.
The Bar also expressed concern about aspects of the reform proposals as creating the potential for unchecked Departmental overreach and an attempt to erode the independence of the referral bar.

Tomorrow barristers will withdraw services from all criminal cases across Northern Ireland with an exception applied to emergency matters.
This action has been taken reluctantly and because criminal practice has become untenable for legal practitioners.
Access to justice is in crisis.
@Justice_NI must take action urgently to uplift fees in criminal cases which remain stuck since 2005, and end a payment delay policy which results in crippling 14-16 week delays in paying practitioners for publicly funded criminal work.

Do you still quote the 30% failure rate of prolapse surgery to your patients?
Time to think again 🤔 ...
The pivotal 1997 Olsen study reported a concerning 29.2% re-operation rate following natural tissue surgery for prolapse in women.
The study, however, is often misinterpreted as the analysis did not adjust for critical confounding factors like obesity, smoking and chronic lung disease in its high risk population.
Generalising these results to more diverse and healthier populations was likely inaccurate and must have contributed to the rush, two decades ago, to use mesh in prolpase surgery.
Subsequently, more robust studies confirmed:
- Re-operation rates following natural tissue surgery is less than 5%.
- Mesh use did not improve patient outcomes, over natural tissue repair.
- Some women experienced life-changing mesh complications.
April 2019: The FDA ordered the manufacturers to remove their prolapse mesh devices from the US market.
November 2019: The Federal Court of Australia found the devices defective and of unmerchantable quality.
January 2020: California court ordered one manufacturer to pay $344 million to the affected women - following a lawsuit filed in 2016 by Kamala Harris, the Attorney General at the time.
However, in most other countries, particularly in Eastern Europe, Asia and South America, the use of mesh in prolapse surgery continues, largely unchecked.
Olsen and similar studies continue to be referenced in the scientific literature to favour the use of mesh devices in prolapse surgery, which is unfortunate.
For the majority of women with prolapse, the most favourable benefit / risk ratio must remain with non-surgical treatment, such as physiotherapy-supervised pelvic floor muscle training and, if required, the safer natural tissue repair surgery.
