SM vs. CBX — The next hearing is scheduled for June 18 at 11:20 a.m.
1. SM denied the validity of CBX's claim of a verbal agreement guaranteeing a distribution commission in exchange for paying 10% of sales
— CBX’s side responded that a verbal agreement can still be valid even without a written contract.
*side note: In the emergency press conference they stated there is a recording of the agreement and later on Chris lee and Sm stated that yes that agreement did indeed happen
2. SM claims to have paid around ₩50 billion to CBX as settlement payments but refuses to provide any settlement data to prove CBX were not underpaid.
— CBX’s side argued, “For example, if revenue is generated from concerts or album sales and needs to be settled, there should be actual sales contracts or revenue data. However, we have never received such materials even once."

However, one thing has become clear over the past three years:
- SM has never denied blackmailing Baekhyun by using the members to get him to sign.
- SM has never denied making Baekhyun sign the contract before it expired when he was still in the military, promising that he could always cancel it afterwards.
- SM has never denied forcing CBX to sign, citing the potential disadvantages the group would suffer if they didn't.
- SM has never denied making the 5.5% verbal promise.
- SM has never denied not paying CBX for the group's latest activities.
- SM has never denied refusing to show them their financial data.
- SM has never denied that CBX immediately offered to pay the various IP fees separately instead of the alleged and unclear IP fees included in the 10% revenue.
- SM has never denied failing to comply with the 2014 additional agreement in the contract, where it stated: which would ‘provide’ the settlement data every 6 months and with each payment (thus allowing artists an objection period of 30 days is counted from the date of 'receipt' of the data).
The bigger picture couldn't be clearer.
