Yesterday on behalf of a client we filed the first Marex tort claim in Kenya. We filed a suit for Kshs 5.7 billion (about US$ 45 million) against a leading commercial bank in the East African region. The Marex tort was developed by the English Supreme Court and states that where a third party gatecrashes into a suit between the parties at the stage of executing a decree and tries to help the judgment debtor delay or escape execution, the decree holder has a claim for damages againt the said gatecrasher. The Marex tort insulates the court decree againt "sponsored, mercenaries and robbers barons" hired by the judgment debtor to defeat the decree issued by court.

If this Gachagua Impeachment decision gets to the Supreme Court & indeed it will, the CJ KOOME cannot sit. She must RECUSE HERSELF having gone to a TV/RADIO media to express her views on Impeachment & the state of its finality. Clearly in clash with Article 99(3) of the Constitution. Such are the REASONS I said here the @Kenyajudiciary should avoid the business of MEDIA PRESENCE by Judges & Magistrates. Let the Administrators do those things. Out here are enough Experts in Law to deal with any issues of National Importance. Judges are not beyond the HOLY GRAIL but are elevated & have a higher calling, I should not meet a Judge in the corridors of Standard Media running for a Show. In our Physical Courts, there is a reason they sit on a RAISED GROUND, it is not a Housing Design for cosmetic reasons.

Under Article 25(c) of the constitution, the right to fair trial is a non-derogable right. So how can the court make quasi constitutional excuses on amorphous grounds in its refusal to set aside the impeachment of Hon Rigathi Gachagua? The Gachagua judgment in my humble opinion is on a shaky, shallow, soggy and sandy soil.
