I believe unconditional love. I'm a Husband, Father, Grandfather, Real Estate Broker, Gourmet Mushroom farmer, Defender of the Constitution, J6er and Patriot.
What is stopping the Trump admin from issuing a formal apology and expunging J6 arrest records today? It is no cost and will positively impact their lives forever. It does not need any congressional or judicial approval. It can be done with the stroke of a pen.
Ben Martin @OneRealPOV is still fighting for his freedom, 18 months later.
Most people think this case was resolved when President Trump @POTUS pardoned January 6 defendants in January 2025. It wasn’t.
Ben was convicted in a separate California federal case for possessing firearms that were found during a search tied to his January 6 investigation. He was sentenced to 38 months.
After the pardon, the district court ruled the pardon did not cover this gun case.
He appealed to the Ninth Circuit (Case No. 24-7203).
The appeal has now been pending for 18 months (Notice of Appeal filed Nov 27, 2024). An amended record was filed just last week. He’s currently out on release ordered by the 9th Circuit, but the conviction still stands until the appeal is decided.
The government itself later moved to vacate his conviction and dismiss the case, stating it was consistent with the President’s instructions.
Similar Jan. 6 related gun cases have been dismissed on the same grounds.
What should happen:
The Ninth Circuit should vacate the conviction based on the presidential pardon. The government has already aligned with that position.
This isn’t about relitigating the gun charge, it’s about honoring the broad clemency the President granted for January 6-related matters.
Ben is still in the fight.
His case is active, and the outcome matters for clearing his record.
I didn’t just sit in a few J6 trials, I testified in 10 of them, and I worked to receive my license from the DOJ to be a video investigator. I was also in attendance on J6 and took a film crew, so I have a very unique perspective and archive, and privileged to access government videos the public will never see.
Nobody testified in more trials than I did, and dozens of lawyers used my research for hundreds of J6 defendants.
If you didn’t know, it’s because nobody wanted you to know.
Think about that for a minute…
@Eevildebs1@ProudArmymom66@AliceMarieFree I did get pardoned. I had a judge overstep her branch of government and into the executive branch (a clear violation ) to determine the pardon didn't apply to me. That is the simple explanation.
Apparently, there are some secret FBI videos from J6 that they don’t want released. I’m trying to figure out which ones so I don’t drop them to the public by accident. I would much rather do that on purpose.
@AliceMarieFree@OneRealPOV Alice, he’s a J6’er who is out on appeal. Charges stem from the J6 raid on his home. The judge in his case would not accept the pardon language. He could use a second pardon.
@JonathanCohn No she didn't win in court because there was no eveidence to convict him. HE WAS NEVER CHARGED CRIMINALLY YOU IDIOT!
Civil court is different, I can accuse you of the same thing and if the media likes the story guess what I WIN!!
Stop twisting the facts!
There's a 911 in Upstate New York!! Ain't that right @GovKathyHochul ?? Kathy, why do you hate Upstate farmers so much? Let's see what America has to say about this, shall we? If you stand with American Farmers, hit REPOST. Volume UP!👇
The biggest lies Democrats and their media partners continue to lie about 100% of the time is that the stolen 2020 election was legit, J6 was an insurrection, Brian Sicknick dying on J6, George Floyd being killed by Derek Chauvin instead of a death overdose, and anything Trump.
The 2020 election was stolen!
J6 was an inside job where 4 Trump supporters died on that day, at the hands of CHP, and no cops died on J6!
George Floyd died of a fentanyl overdose, not by Derek Chauvin!
Democrats make threats against Trump and America daily, yet not ONE single person has ever been arrested or held accountable.
Did you know that Capitol Police failed to use their loud public address system to instruct people to stay away from the Capitol on January 6 until the evening hours when most people had already left?
Congress must pass a law protecting January 6th political prisoners as a targeted class of American citizens whose civil rights have been systematically violated.
We've endured persecution, prosecution, prison time, financial ruin, ruined reputations, destroyed careers, families torn apart, endless media lies, a fraudulent narrative in history books, and even a Capitol plaque falsely labeling us insurrectionists when not a single person was charged with insurrection.
This selective political persecution must end. America demands equal justice.
