Derek Chauvin just filed his third petition seeking to vacate his state murder conviction and dismiss the charges in the George Floyd case.

His legal team argues the entire prosecution was illegitimate claiming Gov. Tim Walz’s assignment of the case to AG Keith Ellison was unlawful, that no grand jury was ever convened, and that no indictment was secured. They call these structural due-process violations that strip the courts of jurisdiction.

Elon Musk’s recent posts calling Chauvin “unjustly convicted” and declaring “he is not a murderer” have poured real energy into the case and put it back in the national spotlight.

President Trump previously helped free Tina Peters after sustained public and private pressure on Colorado officials. He has the same power (and more) when it comes to Chauvin’s concurrent federal sentence. A presidential pardon on the federal side, combined with success on this new state petition, could finally free an innocent man.
