The Court of Appeal today affirmed the decision of the lower court in th case of @CustomsNG vs Chikaosolu Ojukwu that:
1. Personal items (not for sale, exchange or barter) are exempt from the payment of import duties and other associated levies under the Customs and Excise Act and related Regulations.
2. The definition of “luxury goods” does not include personal items such as mobile telephones, no matter how expensive they are alleged to be and the Nigerian Customs Service is not permitted in law to levy import duties on such items.

How PAYE Works:
—- Employers calculate the tax based on the employee’s earnings using the rates specified in the Personal Income Tax Act (PITA).
—- The calculated tax amount is deducted from the employee's salary.
—- Employers remit the deducted tax to the relevant tax authorities monthly.
—- The tax rates are progressive, meaning higher incomes are taxed at higher rates.

• Above ₦3,200,000 at 24%
—- Employers who fail to remit PAYE taxes on time are liable to pay a 10% penalty on the amount due.
—- An additional interest of 5% above the Central Bank of Nigeria’s Monetary Policy Rate (MPR) is charged for each month the payment is delayed.
—- If an employer fails to deduct PAYE taxes, the employer is liable to pay the tax due, along with a penalty of 10% of the tax due, plus interest at the MPR + 5%.
—- Employers must file annual PAYE returns with the relevant tax authorities..
