How freedom of speech is criminalised in Germany:
1.“From the river to the sea” Controversy:
•people using the phrase “Palestine will be free from the river to the sea” has been criminalized in Germany when interpreted as a call for the destruction of Israel. Authorities and courts argue that it can be linked to anti-Semitism or incitement to violence.
•Supporters, however, emphasize that the phrase is a geographical reference and reflects a political aspiration tied to historical understanding and the desire for Palestinian sovereignty.
2.Use of Banned Symbols:
•Individuals have been charged for displaying symbols linked to groups deemed terrorist organizations in Germany, such as Hamas.
•Critics argue that such charges often target expressions of solidarity with Palestinians, raising concerns about overreach and the suppression of political speech.
3.Comparisons with the Holocaust:
•Comparing the situation in Gaza to the Holocaust has led to charges under German laws that protect the singularity of the Holocaust as an unparalleled genocide.
•Courts often view such comparisons as trivializing the Holocaust, equating it with far lesser atrocities. However, some lawyers have successfully argued that comparing two events does not necessarily minimize the gravity of either.
•In at least one case, judges were convinced that drawing parallels between Gaza and the Holocaust did not diminish the Holocaust’s historical significance.
4.Balancing Freedom of Expression and Historical Sensitivity:
•Germany’s legal framework reflects its commitment to combating anti-Semitism and safeguarding the memory of the Holocaust.
•Critics, including legal experts and human rights advocates, argue that applying these laws to penalize speech about Palestine suppresses legitimate political discourse and stifles debates on international human rights issues.

•Cases where lawyers successfully defended individuals by framing their comparisons or statements as part of free expression could set important precedents. These decisions underscore the ongoing struggle to balance historical accountability with the protection of democratic freedoms.
6. Some cases were criminalised for posting videos of Hamas and were expelled from #Germany and denied citizenship.

Thanks for students and staff in #Frankfurt for organising the @Pal_Con_Ffm Talking about the Silencing of Palestine conference to discuss epistemic violence against academics and students voices supporting #Palestine. It is students movements who are empowering academic staff, like myself, by opening spaces for dialogue about peace and human rights and ending genocide. It is a shame that the University of Goethe cancelled the conference venue, instead of being proud of its students and staff for making Frankfurt a space for interdisciplinary and international debates. This is all from money raised by the students.
We discussed the status of academic freedom and knowledge production worldwide. We live in an age of knowledge production crisis. Universities in the West are no more spaces for knowledge production and freedom. They say if you want to learn about a nation’s value, look at how they treat their intellectuals. While academics in places like the UK are treated like cash machines, academics in Palestine are treated as ‘terrorist’ and legitimate targets by the Israeli colonial state. What ‘humans’ universities will produce in the future if they remain spaces of colonial legacy, elite domination and endorsement of human rights violations.
Drawing on Raphael Lemkin, we discussed social methods used in genocide attacking and assassinating intelligentsia including national leadership, medical staff and journalist. According to a UN report published in April 2024, Israel also committed scholasticide killing 100 professors, and injuring more than 8000 students and 800 teachers. Another 195 heritage sites, 227 mosques and three churches have been damaged or destroyed, including the Central Archives of #Gaza, containing 150 years of history.
