This one is tough. She could feel threatened because he didn’t walk away, but, neither did she. She didn’t call for help either. 2. He has no weapon, and never once gets into her personal space; but, he continues to advance toward her. 3. Neither makes any physical contact. Was there any threat of violence? We don’t know. We can’t hear what they are saying in the video. 4. Yes, he is an Army Vet, but how would she know that? For me, as a female, men are bigger and stronger than I. I wouldn’t want an irate man to get close to me. 5. She seemed to approach him first, which could mean she wasn’t afraid of him at all. That would be problematic. However, he didn’t back down, even after he knew she had a gun.

You know, this is what happens when people focus on looks over heart and quality of the person. Not that a person who takes care of themselves is not a good person, but when we qualify a “date” on the photo appearance of a person we are setting ourselves up for failure. Know that a person becomes more beautiful when we actually get to know their heart.
Okay, let’s just look at things realistically. IF there are high profile, multimillionaire “people” who were part of the Epstein horrors, do you NOT THINK they would have protected themselves? Would Epstein not have hidden their identity with some kind of safeguards for himself? According to Lively's Memo, this amount represents "the fees and costs that relate to (i) motion practice associated with the Wayfarer Action, including, but not limited to, the prevailing MTD, then Rule 11 Motion, and motions to compel; (ii) work performed associated with the Consolidated Action as a whole, including discovery through the deadline for the Wayfarer Parties to amend their pleading that was relevant to both actions; and (iii) Lively’s 47.1 Motion, including this application."
Lively lawyers are arguing that: "Section 47.1 does not limit the recovery of reasonable attorney’s fees and costs to the successful defense of a particular claim (i.e., defamation), but, instead, applies to the successful defense of “the litigation.” Cal. Civ. Code § 47.1(b)."
I completely disagree with this argument. It is preposterous. California Civil Code section 47.1(b) provides as follows:
"A prevailing defendant in any defamation action brought against that defendant for making a communication that is privileged under this section shall be entitled to their reasonable attorney’s fees and costs for successfully defending themselves in the litigation, plus treble damages for any harm caused to them by the defamation action against them, in addition to punitive damages available under Section 3294 or any other relief otherwise permitted by law."
Section 47.1(b) permits recovery by a defendant in a defamation action. It does not permit recovery by a defendant in any other type of action. The statute further amplified the defamation nexus of the recovery by explaining that the defamation case must have been brought as result of the defendant (Lively) making a privileged communication. Finally, the statute limited the compensatory and treble damages to the harm caused by the defamation action. Thus, it could not have been clearer that the statute was focused on the defamation action.
Lively's lawyers are arguing that when the statute permitted recovery for "successfully defending themselves in the litigation", the word "litigation" refers to the entire lawsuit, not just the defamation portion. This is ridiculous. Using simple English construction, it is readily apparent that in using the term "the litigation", the statute was referring to an already identified or discussed litigation or legal action. It makes no sense for the statute to use the term "the litigation" when no litigation had previously been identified, referenced or discussed. As a matter of fact, however, the statute had previously identified a form of litigation, namely, the defamation action. Defending oneself in the defamation action and prevailing in that defense is litigation. That's "the litigation" that the statute mentioned when it permitted a prevailing defendant to recover attorney's fees and costs.
Lively's argument on this issue is so ridiculous that her lawyers risk losing credibility with the judge. Let's see how Wayfarer responds. I have not even begun to discuss the itemization of the fees.
