“Por opção” é das piores justificações que existem. Eu e a minha empresa também nos dava imenso jeito por opção não pagar impostos, o problema é que um contrato de trabalho num estado social envolve 3 signatários.. um deles o Estado.

Não estou a dizer que é obrigatório. Mas um contrato de serviços com uma empresa tem certos fins, e um contrato de trabalho tem outros.

Depois de ter visto centenas de contratos na minha vida, casos em tribunal, etc, o teste mais simples é que se há um número de dias de férias a marcar junto da entidade contratante, é contrato de trabalho. Outros bons testes são os que disse: haver um chefe na organização, avaliação, promoções, retiros, horário de trabalho e/ou escritório, etc etc.

A lei deixa pouca margem para dúvidas.

Casos em que não é assim:
- um advogado que contratas: não ditas as férias dele, nem o horário dele, é mais “um projeto” ou uma “avença”
- tarefeiros, como uma empresa de limpezas, etc. eles garantem que há limpeza todos os dias mas eles é que têm de tratar da rotação para férias, fins de semana, etc.

No software, PODES fazer isso, e já pensei várias vezes montar um negócio assim:
- contribuições sobre repositórios open-source, sem marcação de férias, pago à peça/ projeto/ alocação, sem forçar ou recomendar método de trabalho, apenas focando na qualidade e parâmetros da entrega. Mas na prática poucas desta empresas fazem assim..

So often I speak to founders who say “our product is the best xxx” and the whole point is to disambiguate what they mean by “the best”

The best startup pitches, like the best books, make claims that are unequivocal. A lot of what I do in office hours at this point in the batch, with demo day approaching, is figure out exactly how much the startup can truly claim.

Com os médicos, dependendo da situação, pode ou não ser “contrato falso”.

Muitos médios mantém relação distante com esses hospitais ou clínicas, vão lá trabalhar à peça ou ao dia, mandam eles no horário, tem imensa flexibilidade, ninguém diz como fazer o trabalho etc.

Nada disto se passa em tech. Os engs tem um só emprego, as empresas atribuem e contabilizam férias, etc etc… no final do dia, é MUITO claro que é um contrato de trabalho, apesar de não ser formalizado assim.

Cada um sabe de si, e é do Estado e do legislador metade da culpa, ao criar um sistema absolutamente complicado, sobretudo para relações modernas de trabalho (Ubers, remotes, contractors, múltiplos trabalhos, trabalho ao projeto, etc).

Claro que é um problema!

O trabalho tem uma definição muito particular. Normalmente ninguém se chateia, mas se a Seg Social ou o trabalhador quiserem, quando vai a tribunal, o juiz pode determinar que essa relação é na verdade um contrato de trabalho empolado —- e quase sempre é.

Contrato com empresa: empresa define objetivos e o trabalhador decide quando trabalha, as ferramentas etc.

Contrato de trabalho: empresa diz como fazer, quando, horário, local, empresa atribui e contabiliza férias, faz retiros, da treino etc.

Só porque existe uma “figura legal” não quer dizer que essa não seja ilegal.

We have a couple of stories, not like those but close enough

1) Very famous partner of world renowned VC called us, met us, then later wanted to preempt a series B. Told us terms and all, no TS yet. Then he disappeared, and we heard through the grapevine that he got blocked by peers. (Don’t blame them).

2) Closed a round, then the partner who did our deal quit next week. We moved ahead with another partner who was new at the firm.

3) The day before going to Notary to close a round, the partner of a fund says “I don’t allow my POA to be used unless Humberto comes here tomorrow morning.” Wouldn’t tell me what he wanted over the phone or email. I flew there, he asked 2 or 3 simple questions already covered, made a speech to company with me and everyone else standing, let the round proceed. On the way back I expensed back the costlier steak lunch I could think of.

4) Had a partner meeting with a tier 1 Silicon Valley VC, meeting went well. I forgot a charger or something at the VC office, and as I was walking up the stairs of their office 10min later I heard them say “wow, really really cool, these guys are amazing”. Told my cofounder “we bagged it”. Then they introduced us to the founder of the fund who proceeded to say “don’t believe in spreadsheets” or something like that. Deal died.

Two of our worst VC stories:

1. A Sequoia partner passed on Cloudflare because he didn’t think a woman could lead a security infrastructure company. Seriously. 🙄

2. I got introduced to @pmarca. Meeting got scheduled for a Monday, which should have been a clue. I thought it was just a casual meeting. He thought it was a pitch and brought the whole @a16z partnership team. Hilarity ensued. 🤪 At one point one of them said: “You don’t seem very prepared.” Which was true because I wasn’t. I framed the rejection letter they sent.

None of this guarantees recursive self-improvement is on the horizon. It’s not yet clear that Claude is capable of research judgment—of choosing the right problems to work on.

But if these trends continue, AI systems designing and building their own successors is plausible. This could revolutionize society—medicine, technology, the economy—for the better. But it may also compound alignment issues and ultimately lead to loss of control.
