AN ACT Prohibiting intentional atmospheric intervention and weather modification activities in the state; establishing civil and criminal penalties; authorizing enforcement mechanisms; and providing for an effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF ALASKA:
SECTION 1. AS 46 is amended by adding a new chapter to read:
Chapter 18. Atmospheric Integrity and Weather Modification Prohibition Act
Sec. 46.18.010. Short title.
This chapter may be cited as the Alaska Atmospheric Integrity Act.
Sec. 46.18.020. Findings and intent.
The people of the State of Alaska find and declare that:
The people of Alaska have a fundamental interest in preserving the natural composition, behavior, and dynamics of the atmosphere over the state to safeguard public health, safety, water resources, wildlife, fisheries, agriculture, and the environment;
The intentional release or dispersion of substances into the atmosphere to manipulate temperature, weather, climate, precipitation, or solar radiation presents unverified ecological and health risks that the state has a compelling interest in preventing;
The state retains primary authority to protect its air quality and natural resources under its police powers; and
A clear statutory prohibition is necessary to prevent unauthorized atmospheric intervention within the state’s borders.
Sec. 46.18.030. Definitions.
In this chapter, unless the context otherwise requires:
"Apparatus" means any equipment, aircraft, unmanned aerial system (drone), balloon, satellite, ground-based generator, flare, disperser, ionizer, or other mechanical or electronic instrument capable of releasing or dispersing substances into the atmosphere;
"Atmosphere" means the ambient air mass within the territorial boundaries and airspace of the State of Alaska;
"Chemical or substance" means any particulate, aerosol, gas, liquid, solid, or mixture, including silver iodide, dry ice, salts, sulfates, or other seeding agents, whether natural or synthetic;
"Express purpose" means deliberate intent, evidenced by operational plans, system design, or public statements, to alter or attempt to alter atmospheric or weather conditions;
"Person" has the meaning given in AS 01.10.060 and includes governmental entities, research institutions, and universities;
"Weather modification or atmospheric intervention" means any intentional activity that injects, releases, or deploys a chemical, substance, or apparatus into the atmosphere for the express purpose of altering or attempting to alter temperature, weather, climate, precipitation, cloud dynamics, or solar radiation intensity. This includes cloud seeding, solar radiation modification, and related experimental or operational testing.
Sec. 46.18.040. Unlawful atmospheric intervention.
(a) Except as provided in AS 46.18.050, a person may not intentionally inject, release, disperse, or cause to be dispersed any chemical, substance, or apparatus into the atmosphere within the state for the express purpose of weather modification or atmospheric intervention.
(b) A person may not knowingly provide, transport, or supply equipment or substances to another person for use in violation of (a) of this section.
(c) A state agency or political subdivision of the state may not license, fund, or engage in any activity prohibited under this section.
Sec. 46.18.050. Exemptions.
The prohibitions in AS 46.18.040 do not apply to:
Activities conducted entirely within a fully enclosed building, sealed laboratory, or contained research facility with no release into the ambient outdoor atmosphere;
Aerial application of fire retardants or suppressants below 1,000 feet above ground level for the purpose of controlling an active wildfire under the authority of an authorized state or federal fire management official; or
Standard agricultural operations below 1,000 feet above ground level, including the aerial application of seeds, fertilizers, or pesticides in compliance with applicable state and federal permits, not undertaken for the purpose of weather or climate alteration.
Sec. 46.18.060. Penalties and remedies.
(a) A person who knowingly violates AS 46.18.040 commits a class B felony and, upon conviction, is subject to the penalties provided in AS 12.55, including a fine not to exceed $500,000 for an individual or $5,000,000 for an organization.
(b) In addition to criminal penalties, a person who violates AS 46.18.040 is liable to the state for a civil penalty of not less than $100,000 and not more than $1,000,000 per violation, plus costs of investigation and environmental remediation. Each day of continuous violation constitutes a separate offense.
(c) Apparatus, equipment, or aircraft used in a violation of this chapter may be subject to civil forfeiture under standard state forfeiture procedures.
(d) Civil penalties and fines collected under this section shall be deposited into the general fund in accordance with state law.
Sec. 46.18.070. Enforcement.
(a) The Department of Environmental Conservation and the Department of Public Safety have authority to investigate and enforce the provisions of this chapter.
(b) The Department of Environmental Conservation shall maintain a public portal to receive reports of suspected violations.
(c) The attorney general may initiate a civil action in superior court for injunctive relief, civil penalties, and restitution.
(d) An affected resident of the state may bring a civil action in superior court to enjoin an ongoing or imminent violation of AS 46.18.040. The court may award reasonable attorney fees and costs to a prevailing plaintiff under Alaska Rules of Civil Procedure.
Sec. 46.18.080. Savings clause and severability.
(a) Nothing in this chapter applies to normal commercial or general aviation emissions regulated under federal law, provided such operations are not conducted for the express purpose of weather modification.
(b) If any provision of this chapter, or the application thereof to any person or circumstance, is held invalid, the remainder of the chapter and the application to other persons or circumstances shall not be affected.
SECTION 2. This Act takes effect 90 days after enactment.
Key Initiative Process Reminders
Signature Threshold: In Alaska, an initiative petition requires the certified signatures of qualified voters equal to at least 10% of the total votes cast in the last general election, spanning across at least three-fourths of the state's house districts.
Review Process: Before circulation, the Lieutenant Governor and the Department of Law review the application for form, proper titling, and compliance with constitutional restrictions (such as ensuring no prohibited appropriations or local/special legislation).

Just so Im clear, Rainmaker, a California Co, was cloud seeding to make it rain, which we were informed was not a thing and definitely not happening, on the Kenai Peninsula where it was forecasted, checks weather report, to rain. They claim to have made 19 million gallons of precipitation in a place that has already had above normal rain this summer instead of making it rain over any number of the thousands of current forest fires burned in the country.
