Attorneys have a professional and ethical obligation to ensure that the laws they rely upon in their work are current, accurate, and in effect. ABA Model Rule of Professional Conduct 1.1 requires lawyers to independently research and verify legal authorities rather than passively accepting third-party assertions without scrutiny. Frivolous filings, or misrepresentations based upon blind reliance of a third party's claims about a law's status are a violation of that duty.

Moreover, for all of the prominent attorneys (including the "former high-ranking DOJ officials" 🙄) who cited the false assertions of a third party (SOS's General Counsel, Charlene McGowan) instead of the law- suggests that they all knew that the law required ballot images to be preserved. IOW- they intentionally and knowingly misled the court. Knowingly making false statements of fact and law to a federal court is a very serious offense- and a violation of the Rules of Professional Conduct. Am I alleging that those attorneys broke the law? Yes, I am.
