The Court of Appeal ordered their immediate release pending the hearing of their substantive judicial review of the PDO. That CA also refused the State's application for conditional leave to appeal to the Privy Council.

Later that day, the State applied for a different leave (as of right) to appeal to the PC and was granted that by a different panel of the CA. Also the State applied for a stay of the order of release pending the hearing of the appeal, which the CA agreed with. Which is why the people have not been released at this point.

The Trib has recommended release of only Dominic, but the State maintains that the recommendation was given without reasons being given; without the State being aware of his written arguments; or without the State being offered an opportunity to respond to them. These are ostensibly the reasons for not accepting the Trib's recommendation at this point.
