Pakistan is getting rid of its “period tax.”

Finance Minister Muhammad Aurangzeb said the country will eliminate its 18% sales tax on locally produced sanitary pads and contraceptives — thanks to a landmark legal victory. “Pakistan is the fifth-largest country in the world in terms of population,” Aurangzeb said. “Family planning is a top priority.”

Two lawyers, Mahnoor Omer, 25, and Ahsan Jehangir Khan, 29, filed a “200-page” petition in Lahore High Court alleging the 18% sales tax on menstrual products was a “pink tax” that discriminated against girls and women.

Omer and Khan argued that the government tax violates article 25 of the country’s constitution, which prohibits discrimination on the basis of sex. The two also argued that menstrual products aren’t “luxury goods” but essential items. That means an 18% tax on feminine hygiene products makes it far more difficult for women and girls to participate fully in public life. 

According to UNICEF, just 12% of Pakistan’s women and girls use commercial sanitary products. Experts claim that they are forced to resort to homemade products, such as rags, because a pack of 30 pads can cost more than a day’s income for many families. And if people buy imported menstrual products, they pay an additional 25% import tax. 

The case “highlighted the absurdity of the taxation regime,” Khan told CNN. “If there was never a constitutional petition, the government would not have woken up to the fact that even the sales tax is wrong.” The lawyers amplified their case with a “viral” petition that garnered thousands of signatures. 

Notably, the 25% import tax still exists. The two lawyers plan to contest it next. “Our fight is very much ongoing,” Khan told CNN. “

Pakistan joins other regions, including India, Nepal, Scotland, and several U.S. states, in removing or lowering taxes on menstrual products.
