@DeMoLIRI_PS5@day_lori @momo198319 @nicksortor That has nothing to do with anything lol. A good guide to defamation is that the more specific you are, the easier it is to win. Calling someone a Nazi is broad. It’s also used as an insult so much it’s lost its meaning.
@420MountainRoad @momo198319 @nicksortor It doesn’t matter how’s it’s stated. If someone says “I think you’re a Nazi” vs “you’re a Nazi” it makes no difference legally of how you say it. Both are opinions.
The bigger problem is that Elon would have to prove actual malice, which again, is almost impossible.
@420MountainRoad @momo198319 @nicksortor It literally is an opinion so it’s protected by the first amendment. Insults like groomer and Marxist are used all the time by republicans and it’s protected when they do it despite it almost always being wrong. Also he’d need to prove actual malice which is almost impossible.
@rulefollower@esjesjesj It’s not defamation. He expressed opinions which is covered by the first amendment. The term ‘Nazi’ is also used so much it’s lost a lot of its meaning. There’s also the little problem of proving actual malice. This is a frivolous lawsuit and a waste of time.
@TechnoViking600@BMoreDefiant@Chuckykickass@elonmusk@ThomasMHern If that’s what you want to believe then sure.
He expressed opinions of Elon. Republicans call Democrats ‘Marxists’, and ‘groomers’ all the time. That’s also protected speech.
If Elon wants to sue he’ll also need to prove actual malice which is nearly impossible.
@day_lori @momo198319 @nicksortor It’s the other way around. Elon has to prove he isn’t a Nazi & prove actual malice which is almost impossible. It’s a frivolous lawsuit showing he hates free speech if it’s used by people he doesn’t like.

@BizarroTrump10@BradMossEsq Did you read the link? Probably not, but the relationship from a charter is more symbolic if anything. The government doesn’t control a private college because of a charter. How does a self proclaimed lawyer not know the law?
