SBTC just learned that moments ago, @Pink__Cheetah through her attorney @SocciLaw filed a dispositive "Motion for Summary Reversal" with the U.S. Court of Appeals for the D.C. Circuit, arguing the District Court erred in not using the statutory definition of the term "order" that Congress enacted in the Administrative Procedure Act (5 U.S.C. ยง 551(6)) when adjudicating whether the authoritative November 30, 2023 email from FMCSA to TQL was an order. Pink Cheetah argues the communication qualifies as an order subject to enforcement by the courts pursuant to the right of private action afforded to a person injured by a broker for failure to comply with an order of the Secretary under 49 U.S.C ยง 14704.

You mean no RANDOM ROADSIDE INSPECTIONS.
Not to be confused with PERIODIC INSPECTIONS defined under 49 CFR ยง 396.17, which is a mandatory, comprehensive safety evaluation required at least once every 12 months for every commercial motor vehicle operating on public highways.
You had better not be labeling carriers as being uninspected or you and the SBTC are going to have a major class action legal issue grounded in unreasonable restraint of trade.
@SocciLaw will be watching for your prompt correction. We trust you will immediately issue a redaction and cease and desist from leading the industry to believe small business carriers' vehicles are not inspected just because they haven't yet been randomly inspected roadside.
