最近，我突然收到了一张法院传票，得知我竟然被360公司以侵犯名誉权为由起诉了，索赔金额高达10万元。

事情源于去年6月6日，周鸿祎在360AI浏览器发布会中，为了宣传360AI浏览器中的局部重绘技术���将一幅女性图片以“性感”为关键词对胸部区域进行局部重绘（“图生图”二创）。

但我注意到这张图与本人曾经在LibLib平台发布的AWPortrait1.2的示例图（由我本人创作的AIGC作品）高度相似，该示例图本人亦在多个平台进行发布过。因��，本人在网络平台针对360公司的行为发表合理质疑。

在此事得到各位朋友的关注后，对方公司副总裁梁志辉公开表态“愿通过法律途径解决版权争议”，然而在我积极准备维权材料之时，未料竟先被对方以“侵犯名誉权”为由起诉，我的合理质疑竟成了对方嘴里的“歪曲的、不实的、诋毁性言论”。

但我不知道我何时说过“360AI技术不行”这句话？还是说断章取义拼凑也算吗？

在这里需要强调的是，360公司副总裁梁志辉、公司员工、代理律师均在不同场合亲口承认过所涉争议图片系在我的「原创AI图片」上「重绘」而来。

在此，我想三问某公司：

第1， 我质疑���是发布会现场使用的AI图片没有尊重作者原创，未经授权的“重绘”二创行为侵犯了我的合法权益。名誉利益侵害应当是质疑内容对应实际名誉受损的主体，而本案发布会举办地及其搜索公司注册地均在北京，即便对方认为我侵权也应在北京进行诉讼，强行将管辖拉到天津究竟是出于什么考量？

第2， 我提出的诉求始终是要求360公司象征性赔偿1元并公开道歉，与此相对的是360公司对我提出了10万元的“天价赔偿”，这个赔偿是如何计算的，依据是什么？

第3， 此前多家媒体的公开报道中，360方均表示“愿依法解决版权争议”，但事实上对方在去年6月20日就拟好诉状准备起诉我名誉权侵权，所以“提起名誉权纠纷”并要求我赔偿10万“天价”就是360方所��的版权纠纷的“依法解决方案”？

作为普通创作者，我不敢揣测互联网大厂选择管辖法院的考量，也不能理解10万“天价”（与我的1元相比）索赔金额的逻辑和依据，但我依然相信公开透明的讨论更有助于公众厘清事件全貌。

在此我也重申我的基本诉求：对于周鸿祎及360发布会未经授权使用我作品进行的“图生图”二创行为，我会坚持依法维权；对于名誉权侵权的不实指控，我也绝不会被迫认下我没有说过的话。

“重绘”算不算“抄袭”？“图生图”算不算侵犯原作者的合法权益？AI时代“二创”的边界到底在哪里？以上不是我一个人的疑问，被“二创”、被“图生图”、被“洗稿”亦是我背后千千万万创作者会面临的困境。AI时代，我们究竟该如何拿起法律的武器，维护我们自身的合法权益？

本次名誉权诉讼虽偏离��作权争议轨道，我仍会依法应诉维护我的合法权益，相信法院会给我一个公平、公正、公开的审判结果，让我作为当事人在司法案件中感受到公平正义。

我期待通过司法途径澄清事实，更期待回归真正的版权议题探讨。另案著作权及不正当竞争纠纷我和我的代理律师@lawyerfeiyingli 也在持续推进维权工作，我会拿起法律武器，等待属于我的公平正义。
