There is no offence in Indian law called prostitution. Even the one law which touches upon this subject - The Immoral Traffic (Prevention) Act, 1956 does not outrightly criminalise an adult selling sex in private, and the Supreme Court said exactly this in 2022 when it directed police not to take criminal action against consenting adult sex workers.

What the statute actually reaches is the apparatus around it, running a brothel, living off someone else's earnings, soliciting in public, operating within 200 metres of a school or a hospital. So the thing being demanded here mostly exists already.

What does not exist is a regulatory framework, and that is the whole problem, because an industry that is neither banned nor licensed is one where nobody stuck inside it against their will can call the police. A trafficked fifteen year old cannot walk into a thana and name the men holding her without walking into a law that has historically been used to detain her in a protective home.

The only people who benefit from the existing grey zone are those police officials involved in hafta vasooli and organized criminal gangs which are happy to pay them off to look the other way when they traffic kids and unwilling women.
