I agree it will come up in court. Not so sure it will have any effect. Children routinely assigned to live with abusive or killer moms even in clear-cut cases. "Best interests of the child" standard & "tender years doctrine". Latter officially stricken from the books in many jurisdictions to create illusion of lack of sexual bias but still de facto in effect.
