@Prof_Phillipson@ProfMarkElliott As I understand it the S of S accepted in argt in Dillon that there remains a power to disapply (but contended it is a power not a duty). Para 145 is surely about the scope, not the existence, of such a remedy. (So I’m not really sure what we are arguing about here.)
@Prof_Phillipson@ProfMarkElliott Maybe, but let’s be careful. As you said in your previous tweet the UKSC are very clear that they are not ruling on that matter in this judgment. (So much of the judgment is a giant caution against incautious implication.)
@Scott_Wortley There could, in fact, be big news today from the Supreme Court—the judgment in Dillon is due for hand down. Perhaps I mean in law, rather than in fact.
