The right to assemble peaceably and without arms is a fundamental right of the citizens of India under Article 19 of the Constitution. So how is the Police Commissioner of Delhi preventing the demonstration at Jantar Mantar? The Police have a right to regulate the assembly and processions under the Police Manual – but this cannot extend to prohibiting the assembly of persons or demonstrations altogether – this would be a violation of the Constitution. The Commissioner of Police cannot take the plea that demonstration at Jantar Mantar would inconvenience the people; because demonstrations have been held there routinely in the past. The Police Commissioner should act in accordance with the Constitution and laws and not according to the illegal dictates of some politician.
This was an issue on which I had a fight with a senior politician of the ruling party (the Speaker of the Assembly) during my first posting in the IAS - as SDM in Jamui. I had given permission for a procession by the Congress. Shri Karpuri Thakur, the then Chief Minister, scheduled visit to Jamui that day. I did not cancel my permission but instructed the leader of the Congress to ensure that the procession ends before the CM reached and would not disturb the CM’s meeting. This is how it happened. However, when the Speaker saw the procession, he lost his temper on the Superintendent of Police who had come to Jamui to cover the CM’s visit. When I reached the spot and saw the Honorable Speaker berating the SP in public. I intervened and told the Hon. Speaker that I had given the permission and that it was the fundamental right of all citizens in a democracy to assemble and take out procession peacefully. This lead to a standing argument with the Speaker in public but I stuck to my stand. I was certain I would be transferred the next day but this did not happen. Both the Honorable Speaker and CM were democrats. This is what IAS & IPS officers are meant to do – uphold the Constitution and the Laws. The Police Commissioner of Delhi may please note.

These reasonable restrictions are imposed by the State.
