Conor doesn't get it. If you grade the homework, the black kids fail. If you suspend troublemakers, they're disproportionately black. Both of those things constitue racial discrimination on the grounds of "disparate impact." The teachers literally do not have a choice.

As sympathetic as I am to principals and teachers, if you run a school that routinely fails to supervise young kids at lunch, or that neglects to review a student's math work for errors, *you should be fired.* That no one demands this or imagines it possible is a problem.

@constans Wait til you hear about how the lowest grade teachers are allowed to give is a 50%. Yes, for zero work. In fact, sometimes missing assignments are simply not graded and the graded ones are on the 50-100 scale!

@conor64 I've worked in one of these schools. If you grade the homework, the black kids fail. A huge number of them. You can't have that if you're an administrator; the district will get sued. Teachers are responding to incentives. Until disparate impact is gone, this is what you get.
