23 years now of watching courts and their judgements closely.
This is part of a larger shift in Indian jurisprudence that many haven't gotten their head around.
Esp the constitutional lawyer / principled first principle folks / ideological sorts who don't have the mental models to deal with this, including Gautam.
We are no longer an adversarial system, that died with the British. If it ever existed.
It eroded and morphed into an inquisitorial one over time.
We are now past that too.
We are now a "system of negotiation".
The world that litigators have to understand (and many are thriving, more below). Something contract and corporate lawyers always did.
Indian courts aren't a place to argue your principles, they are a place to negotiate the least you think your clients can get.
Justice is a balance of interests and not principles.
Menaka is a top class litigator who knows this and all you need to see is her approach to this case to understand this.
Even the great national revolutions of the past -- Russian 1917, French 1789, American 1776, English 1640, German Reformation 1517 -- eventually made peace with the legal tradition that they or some of their leaders had set out to destroy.

German police. No women police for women. Do wrong, police will deal. No gender No easy cute handling.
No problem for UN, CNN, BBC, Hindu, Indian Express, Al Jazeera.
In India, women police for women. Police getting hit, uniform torn, women police getting elboed, pushed, and slapped. The world media comes crashing down.
Why??
#India: We are concerned by reports of mass detentions of demonstrators, protest leaders, members of civil society organisations, lawyers and journalists, before and during today’s large-scale demonstrations in Delhi.
We call on the authorities to ensure that the right to peaceful assembly is fully respected and fulfilled.

I am hearing anarchy is being planned through messaging apps. In Delhi today.
Even professors like Delhi University's VINEETA SHARMA - Associate Professor, Dept of Economics, Kirori Mal College - is apparently instigating people using terrorist Ajmal Kasab's name!
“Full Kasab energy”? Is a mass murderer now the inspiration for people claiming to defend democracy?
If these circulating chats are authentic, references to Kasab alongside alleged discussions of stun guns and chilli powder against police demand an urgent investigation. And people need to be held accountable.
But I wonder, how low will such radical leftist's go!
