Yet another lesson for college athletes based on a phone call that I just received:
A men’s basketball player in the transfer portal has agreed in principle to a NIL agreement concerning a school in the A10.
Against my opinion and judgment three weeks ago, the player signed an agreement with a “NIL agent” requiring the athlete to pay the “NIL agent” 10%.
Here again, the “NIL agent” did not even originate the contract.
COLLEGE ATHLETES PAY ATTENTION: once you enter your name in the transfer portal, coaches contact you directly. They do not contact anyone else.
And should you believe you need a “NIL agent,” make sure you are not paying them an excessive fee - frankly, anything above and beyond what is otherwise permissible in the NBA NFL MLB NHL for originating a revenue sharing and/or an agreement with a NIL collective is unnecessary (third-party brand deals are a different story). I know several good NIL agents (no quotes there) who operate across a variety of college sports and none charge obscene amounts.
So, here we are again, with a player who has originated FOR HIMSELF a contractual offer yet the “NIL agent” is demanding payment of his fee. Worse, the “NIL agent” has zero practical legal experience to even negotiate any of the other critical (and, to be sure, more important) provisions set forth in the 20+ pages of the proposed NIL agreement.
NOW LET’S DO THE MATH;
Contract offer = $150,000
10% to “NIL agent” for having done nothing = $15,000.
And now I am being asked to engage to not only deal with the “NIL agent,” but to negotiate all of the other critical provisions to the NIL agreement (on an hourly rate) to make sure the athlete has protections.
