I guess the climb is steeper than we hoped but that doesn’t mean we’re defeated. We just have to stay strong and keep holding on. While the injunction may hold for now, the main lawsuit is still very much in play.
It’s important to remember that losing an appeal on the injunction doesn’t automatically mean losing the entire legal battle. An injunction is just a temporary measure. It doesn’t decide who’s ultimately right or wrong. What matters most is the outcome of the main case, where all the facts and legal arguments will be fully examined.
Our girls still have every right to fight on. The merits of the case haven’t been ruled on yet, and that’s where everything could shift. There’s still a long road ahead, but as long as they keep standing their ground, we will too.
What’s next for the injunction?
- If the appeal to an injunction decision is denied by the Seoul High Court, the next and final step would be a “재항고” (re-appeal) to the Supreme Court. But only on points of law, not factual disputes. It means the court won’t re-examine the facts of the case (like who said what, who did what, or what actually happened). That’s already been handled by the lower courts. Instead, the Supreme Court will only review whether the law was applied correctly.
- Request the court to modify or dissolve the injunction later, especially if new evidence emerges or circumstances change significantly.
- Courts can lift an injunction during the course of the main suit if it’s proven to be no longer justified.
