Today, the High Court has reaffirmed a simple but powerful constitutional truth. Public office is not a shield against accountability. Public information belongs to the people, and every State officer has a duty to uphold transparency, accountability, and the rule of law. The court found that my constitutional right to access information held by the Busia County Government had been violated. Judgement in Omtatah v @HonOtuoma issued on 27.07.2026 by the High Court at Vihiga. NO PUBLIC OFFICE IS ABOVE THE CONSTITUTION

This case has never been about personalities. It has always been about protecting public resources, defending the Constitution, and ensuring that no public institution operates in secrecy. The judgment sends a clear message that openness, public participation, and constitutional governance are not optional. They are legal obligations.

I welcome this decision as a victory for every Kenyan who believes that public power must always remain subject to public scrutiny. Our commitment to defending the Constitution remains unwavering. REASONS WHY I SUPPORT TUTAM:

1. Statehouse allocation increased by Kes 6.8 billion to Kes 13.64 billion from Kes 3.98 billion, a 100.6% increase. Meanwhile, hospitals lacked drugs, doctors, nurses and therapists went months without salaries, schools lacked capitation, and the new higher-education funding model was doing mathematics even Einstein could not understand. The first 20 months in office, the king made 62 foreign trips, visiting a total of 38 countries, by the second anniversary of his presidency he had made about 66 foreign trips just to fulfil his childhood dreams at a total cost of approximately Kes 2 billion, as he travelled, more Kenyans sunk into poverty and payslips got raided to fund the king’s lifestyle in the palace. 3. During the king’s 1st tam tenure, a total of 200 Kenyans died under police instructed brutality, parents mourned, instead of being humane and showing leadership, the king instructed police to shoot more Kenyans on the legs 🦵🏿for fun as his son bought more matatus that keep breaking traffic rules under the watch of NTSA live on cameras. 4. Instead of providing a conducive environment for Kenyans to create jobs for themselves, King Zakayo opted to bill us to build office 🏢 blocks and named them affordable housing to create short term employment and allegedly solving a housing crisis that was never there since almost 3/4 of houses in urban areas remain unoccupied due to affordability issues and not lack of housing. 5. The king oversaw the cost of fuel raising to Kes 207 a litre and blamed an Iranian war that only affected Kenya in the entire world 🌍, after realising the war excuse was a lie, the king decided to solve the problem he created via unnecessary taxation on fuel by reducing the fuel price by Kes 9/- and went to tell wananchi he has reduced the cost of living. That was like stealing someone’s goat, returning one leg and asking them to thank you for your generosity. Wapi makofi 👏🏿 ya rais jameni.

6. Instead of fixing NHIF, the king created a money looting scheme called SHAH that has been a catastrophic failure! The king has continued to publicly declare SHAH as functional despite many hospitals and users stating otherwise. For months, CS Aden Duale has, in my view, engaged in the ethnic profiling of the Kikuyu community. I have formally petitioned the NCIC to investigate. If he fails to honour the Commission's summons within a week, I will pursue all available legal avenues, including relevant international accountability mechanisms like the ICC . FELLOW KENYANS, THE CONSTITUTION IS UNDER SIEGE! 🇰🇪

Our Constitution was designed with one clear principle. No single political office should have unchecked control over public money. That is why it separates political leadership from the management of the country’s finances.

Article 225(1) establishes the National Treasury as the constitutional custodian of public finances. Its role is too important to be left to politics alone.

Yet Section 11 of the Public Finance Management Act places the National Treasury under the National Executive and under the authority of a political Cabinet Secretary.

This is not a small legal issue. It goes to the heart of constitutional governance.

Parliament has the power to make laws that implement the Constitution. It does not have the power to change the Constitution through an ordinary Act of Parliament.

When the independence of public financial management is weakened, the checks that protect taxpayers’ money are weakened too.

The Constitution must remain above politics. Every law passed by Parliament must respect it.

If we fail to defend Chapter Twelve today, we risk eroding one of the most important safeguards for accountability and responsible use of public resources.

The Constitution belongs to all of us. Defending it is a duty we all share.

Today, I lodged a formal complaint with the National Cohesion and Integration Commission (NCIC) against CS Aden Duale over alleged ethnic incitement, profiling of the Kikuyu community, and inflammatory public remarks that threaten national cohesion. No public official should divide Kenyans along ethnic lines. I have urged the Commission to investigate the matter and take appropriate action.
